RESOLUTION NO. 270-1986
A RESOLUTION OF THE BOARD OF COUNTY COMMIS-
S lONERS OF MONROE COUNTY, FLOR IDA,
AUTHORIZING THE MAYOR AND CHAIRMAN OF THE
BOARD TO EXECUTE AN AGREEMENT BY AND BETWEEN
METROPOL I TAN DADE COUNTY AND MONROE COUNTY,
CONCERNING USE OF DADE COUNTY'S HELICOPTER
FOR EMERGENCY TRANSPORTATION OF TRAUMA
VICTIMS.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
That the Mayor and Chairman of the Board of County Commis-
sioners of Monroe County, Florida, is hereby authorized to
execute an Agreement by and between Metropolitan Dade County and
Monroe County, a copy of same being attached hereto, concerning
use of Dade County's helicopter for emergency transportation of
trauma victims.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 5th day of September, A.D. 1986.

AGREEMENT
This Agreement is entered into between Metropolitan Dade County, a
political subdivision of the State of Florida (hereinafter referred to as
"Dade") and Monroe County, a political subdivision of the State of Florida
(hereinafter referred to as "Monroe") as of the date noted herein.
WHEREAS, from time to time victims of medical trauma occurring in
Monroe County are in need of emergency air transportation to hospitals
specializing in the care of trauma; and
WHEREAS, Dade County, through its Fire-Rescue Department, has
operating control of a helicopter used for emergency transportation of trauma
victims to designated trauma centers within Dade County; and
WHEREAS, in recognition of the public service rendered by the
accessibility of emergency air transportation, Dade County is willing to make
available to the trauma victims within Monroe County the use of its helicopter
as specified in this Agreement,
Therefore, both parties agree to the following terms and conditions:
1. Established Dade County Fire-Rescue protocols regarding the
. operation of the heli~opter will govern.
2. The use of Dade's helicopter at the request of Monroe is subject
to its availability. Dade's needs for the helicopter will take precedence.
3. Monroe will ensure and verify at the time of the request for
transportation that approval for the transfer of the patient has been obtained
from the receiving Dade hospital. Approval will be obtained in accordance
with Dade protocols.
4. Agencies authorized to request use of the helicopter is limited
to the Monroe County Volunteer Ambulance Corp and Monroe County Sheriff's
Department. Calls will be coordinated through the Office of Emergency Medical
Services.
5. Dade will seek payment of its transportation charge from ~he
patient or third party payor. However, in the event that full payment is not
received within a reasonable period of time, Monroe will pay the remainder of
the charge, which will be the helicopter charge in accordance with applicable
Dade County "Administrative Orders.
6. Each party and its officials, officers, agents, employees and
servants will hold the other harmless and, to the extent allowed by law, will
indemnify the other with regard to any claims, judgments or settlements
arising out of the party's activities under this Agreement.

Marathon, Florida.
8. This Agreement may be terminated without cause by either party
upon thirty (30) days written notice to the other party.
9. This Agreement shall take effect upon signing and shall continue
in force until terminated as provided in Paragraph 7.
10. This Agreement contains the entire Agreement of the parties and
there shall be no changes hereto unless approved in writing by the parties.
