RESOLUTION NO. 449 -1987
A RESOLUTION APPROVING THE EXPENDITURE OF
$300,000 OF TOURIST DEVELOPMENT TAX REVENUES
FOR BEACH IMPROVEMENTS AND THE REALIGNMENT OF
HIGGS BEACH AND SMATHERS BEACH.
WHEREAS, Section 125.0104, Florida Statutes, authorizes the
expenditure of tourist development tax revenues for the purpose
of financing beach improvement, maintenance, renourishment,
restoration, and erosion control; and
WHEREAS, Section 2-297 of the ~10nroe County Code, relating
to the levy and imposition of tourist development taxes in the
City of Key West earmarked the funds derived from said tax during
the first year of its levy for the purpose of beach improvement,
maintenance, renourishment, restoration and erosion control for
areas within the City of Key West; and
WHEREAS, additional tourist development tax revenues have
been collected throughout the County; and
WHEREAS, the Board of County Commissioners of Monroe County,
Florida have deemed it in the best interest of the public to
expend tourist development tax revenues for the purpose of the
realignment of Higgs Beach and Smathers Beach and the general
improvement of the beaches throughout Monroe County; now there-
fore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1.
The expenditure of $300,000 for beach im-
provements and the realignment of Higgs Beach and Smathers Beach
is hereby approved.
Section 2.
That $175,000 of said appropriation is to be
made available to the City of Key West for the purpose of re-
aligning Smathers Beach.
Section 3.
That $125,000 will be retained by Monroe
County for the use of the Monroe County Beach and Shore
Preservation Authority for the purpose of the realignment of
Higgs Beach and for any other purposes in addition thereto.
Section 4.
That any sums sought from the Tourist Devel-
opment Council funds shall be subj ect to the requirements and
regulations of the Tourist Development Council and the statutes
of Florida governing said Council.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
