RESOLUTION NO. 489-1987
A RESOLUTION EXPRESSING THE MONROE COUNTY COM-
MISSION'S CONCERN WITH REGARD TO THE DEPARTMENT OF
HEALTH AND REHABILITATIVE SERVICES POLICY IN
PROCESSING THE TRANSFER OF LIQUOR LICENSES.
WHEREAS, numerous citizens of Monroe County have expressed
to the Board of County Commissioners their frustration in at-
tempting to transfer their existing liquor licenses t~ bona fide
purchasers of the properties licensed by said licenses; and"
WHEREAS, no development has taken place on said premises to
justify reconsideration of the previous conditions, circum-
stances, or prerequisites upon which the original licenses were
issued; and
WHEREAS, it has been the policy of Monroe County to author-
ize the transfer of alcoholic beverage approvals if the subs tan-
tive requirements for issuance of said approvals had been met by
the applicants when said original approvals were granted and no
development has taken place to justify reconsideration of the
granting of said approvals; and
WHEREAS, the Department of Health and Rehabilitative Ser-
vices of the State of Florida has adopted a policy of requiring
liquor license transferees who are bona fide purchasers of
existing businesses to upgrade and make major alterations and
improvements to said business prior to approving the transfer of
the privileges granted under the State's liquor license and an
occupational license; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1:
That
the
Department
of
Health
and
Rehabilitative Services of the State of Florida is requested to
review its guidelines and procedures for the transfer of liquor
licenses within Monroe County with regard to previously existing
businesses where no development has taken place subsequent to
issuance of the original liquor license.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
