RESOLUTION NO. 228 -1988
A RESOLUTION DEALING WITH STANDARDS FOR
DETERMINING WHETHER A PROJECT COVERED BY A
BUILDING PERMIT HAS BEEN SUSPENDED OR ABAN-
DONED, WHETHER WORK IS BEING CARRIED ON
PROGRESSIVELY IN A SUBSTANTIAL MANNER, AND
WHETHER WORK IN BEING DONE IN A PERIODIC
FASHION.
WHEREAS, the County Commissioner did, by the enactment of
Resolution No. 346-1987, set certain standards for the Building
Official to utilize in interpreting and administering certain
portions of Section 6-105, Monroe County Land Development Regu-
lations; and
WHEREAS, the said Resolution had the undesired effect of
causing the termination of owner/builder permits contrary to the
intent of the Commission and the best interest of the citizens of
Monroe County; and
WHEREAS, it was the intent of the Commission to exempt from
the provisions of Section 9.5-115 (g) those permits which were
issued prior to September 15, 1986, and to permit the progressing
of those permits in accordance with the ordinances in effect at
the time of the issuance; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1.
In determining whether work has been "sus-
pended or abandoned" for 120 day or 60 day consecutive periods of
Section 6-105 (A) and (B), Monroe County Land Development Regu-
lations, it is the policy direction of the Board of County
Commissioners that the Building Official shall consider the
whether the work has been substantially progressed and substan-
tial progress has been made towards completion.
As long as
substantial progress has been made toward completion then such
work shall not be considered suspended or abandoned.
Section 2.
Those building permits issued prior to
September 15, 1986, shall be governed by the ordinances and
resolutions in effect on the date of their issuance in all other
respects.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
