Resolution 106-1987 City of Key West, Florida RESOLUTION NO. 106 -1987 A RESOLUTION OF THE BOARD OF COUNTY COMMIS- SIONERS OF MONROE COUNTY, FLORIDA, AUTHO- RIZING THE MAYOR AND CHAIRMAN OF THE BOARD TO EXECUTE AN INTERLOCAL AGREEMENT BY AND BETWEEN THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, AND THE CITY OF KEY WEST, FLORIDA, CONCERNING THE GARRISON BIGHT BRIDGE AND CAUSEWAY LOCATED IN KEY WEST, FLORIDA. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that said Board hereby authorizes the Mayor and Chairman of the Board to execute an Interlocal Agreement by and between the Board of County Commissioners of Monroe County, Florida, and the City of Key West, Florida, a copy of same being attached hereto, concerning the Garrison Bight Bridge and Causeway located in Key West, Florida. KOLHAGE, Clerk BY: /'/ J' /// i 'V 41;,~~,~L LER APPR lED AS TO F~RM " A~J.. .E~A' $~FFJC!E"CYl;".jf j' BY ~J Attorney's Office ., INTERLOCAL AGREEMENT WHEREAS, Ordinance No. 24-1986 of the County of Monroe establishes a formula for the distribution of the Sixth Cent Local Option Gas Tax between the incorporated municipalities and County Government, which tax was enacted by the Board of County Commissioners of Monroe County, Florida pursuant to the authority granted under ~336.025, Florida Statutes; and WHEREAS, the County of Monroe receives 62%, the City of Key West receives 35%, with the City of Key Colony Beach and the City of Layton receiving 2% and 1% respectively of the proceeds of said tax under said ordinance and pursuant to separate inter local agreements entered into between the County of Monroe and the three municipalities under the authority granted by ~163.01, F.S. and ~336.025, F.S.; and WHEREAS, the use of the proceeds of said tax by the respec- tive jurisdictions is limited to transportation related expendi- tures within their geographical boundaries; and WHEREAS, the Garrison Bight Bridge and Causeway located within the City of Key West forms a part of the Monroe County road system as it is presently functionally classified by order of the Florida Department of Transportation pursuant to ~335.04, F.S. and the repair and maintenance of said bridge and causeway and all its components is an eligible project activity for expenditure of portions of the proceeds of the Local Option Gas Tax by the County of Monroe and the City of Key West; and WHEREAS, the County of Monroe has entered into a contract dated October 7,1986 with Frank Keevan and Sons, Inc. in the amount of $25,725.00 for nonfender system related repairs to the bridge pilings, guardrails, handrails and drainage structures, which work goes beyond the requirements of ~335.04(1)(c)(2), F.S. and further, the County of Monroe has expended additional funds for Engineering Design and Construction Plans for the work now being performed under the existing Keevan contract as well as for the redesign of the Fender System pursuant to United States Coast Guard requirements; and WHEREAS, the construction work currently authorized to be performed by Frank Keevan and Sons, Inc. is scheduled to be completed on February 16, 1987, and if the additional work to replace the Fender System at a bidded cost of $139,700.00 is not authorized prior to that date, there will be a greater resultant cost to the County of Monroe and the City of Key West to cover additional contractor mobilization and administrative costs; now, therefore, pursuant to the authority granted in ~163.01, F.S., it is hereby MUTUALLY AGREED BETWEEN THE COUNTY OF MONROE AND THE CITY OF KEY WEST, FLORIDA, that: 1. The replacement of the Fender System beneath the Garrison Bight Bridge is deemed to be a mutually sponsored emergency project due to its deteriorated condition and its resultant threat to the public safety and continued navigational access. 2. The County of Monroe shall serve as the managing agency for the construction contract with Frank Keevan and Sons, Inc. and shall immediately upon execution hereof by the parties hereto issue a Notice to Proceed to the Contractor with the Fender System replacement project element of the existing contract with that company at a total cost of $139,700.00. 3. The City of Key West, upon completion of the Fender System replacement project and upon presentation to the City of a certificate of substantial completion in accordance with the project specifications, plans and contract documents prepared by the County's Consulting Engineer, shall reimburse the County of Monroe in the amount of $48,895.00 or 35% of the total Fender System replacement construction cost which is equivalent to the City's share of the proceeds of the Local Option Gas Tax and shall constitute the City's total financial obligation under this agreement. 2 This interlocal agreement shall take effect when an executed copy is filed with the Clerk of the Circuit Court, Monroe County, Florida.
