RESOLUTION NO. 390-1986
RESOLUTION UPHOLDING THE DECISION OF THE
BOARD OF ADJUSTMENT OF MONROE COUNTY,
FLORIDA, WITHOUT PREJUDICE, AND DENYING THE
REQUEST OF SHIRLEY MULVEY TO REVERSE THE
DECISION OF THE BOARD OF ADJUSTMENT OF MONROE
COUNTY FLORIDA, THAT DENIED A DIMENSIONAL
VARIANCE FOR PROPERTY LOCATED ON RACCOON KEY,
MONROE COUNTY, FLORIDA.
WHEREAS, on September 4, 1986, the Board of Adjustment of
Monroe County, Florida, denied a request for a dimensional
variance for the following described property:
Lot 20, Block 2, Key Haven Tenth Addition, a
subdivision of part of Raccoon Key and adjacent
submerged lands in Section 23 and 26, Township 67
South, Range 25 East, Monroe County, Florida, as
recorded in Plat Book 5, Page 114 of the Public Records
of Monroe County, Florida.
WHEREAS, Shirley Mulvey has duly appealed said decision to
the Board of County Commissioners of Monroe County, Florida,
sitting as the Board of Appeals, and the Board having reviewed
the transcript of the September 4, 1986 hearing, having
considered the argument of all parties present wishing to speak
on the matter, and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the September 4, 1986, decision of the Board of
Adjustment of Monroe County, Florida, denying a dimensional
variance for the above-described property be, and the same is
hereby upheld.
2. That said Shirley Mulvey be, and she is hereby denied a
reversal of the decision of the Board of Adjustment of Monroe
County, Florida,
denying a dimensional variance for the
above-described property.
3. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a
certified copy of this resolution by certified mail to said Field

Representative, Post Office Box 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, at a
regular meeting of said Board held on the 29th day of December,
A.D. 1986.
