RESOLUTION NO. 096-1985
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA,
AUTHORIZING THE MAYOR AND CHAIRMAN OF THE BOARD
OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, TO EXECUTE AN AGREEMENT BY AND BETWEEN
MISENER MARINE CONSTRUCTION, INC., THE BOARD OF
COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA,
AND THE FLORIDA KEYS ARTIFICIAL REEF ASSOCIA-
TION IN RE: BOATING IMPROVEMENT FUND PROJECT
TO CREATE AN ARTIFICIAL REEF.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that the Mayor and Chairman of the Board
of County Commissioners of Monroe County, Florida, is hereby
authorized to execute an agreement by and between Misener Marine
Construction, Inc., the Board of County Commissioners of Monroe
County,
Florida,
and the Florida Keys Artificial Reef
Association, a copy of same being attached hereto, in re:
Boating Improvement Fund Project to create an artificial reef.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the l2thday of April, A.D. 1985.

THIS AGREEMENT made this 12th day of April, 1985, by and
between MISENER MARINE CONSTRUCTION, INC., Contractors, herein-
after called the "Contractor," and the BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, hereinafter called the
"Owner," and the FLORIDA KEYS ARTIFICIAL REEF ASSOCIATION,
hereinafter called the "FKARA".
.WITNESSETH, that the Contractor, the Owner and the FKARA for

the consideration hereinafter named agree as follows:
1. The Contractor shall furnish all the materials and
perform all the work as required by the Specifications for
Boating Improvement Fund Project at Bahia Honda and elsewhere to
construct an artificial fishing reef in Monroe County, Florida, a
copy of said specifications are attached hereto and made a part
hereof.
2. The Contractor shall be required to provide 100 flat bed
44,000 pound truckloads to be loaded to the maximum legal limit
and the number of barge trips necessary to deliver all of the
material to the chosen reef site, plus all rubble present at the
West and North sides of the Bahia Honda' Bridge.
3. The work to be performed under the contract shall be
commenced within twenty-one (21) days from the date County
provides Notice to Proceed and be completed within 60 days, which
will be supervised for the County by the FKARA.
4. Further, the parties agree that if the Notice to Proceed
has not been given by Owner to Contractor on or before August 18,
1985, that this Agreement shall be null and void.
5. Further, the work to be performed under the contract is
contingent upon receipt of appropriate grant monies from the
State of Florida Department of Natural Resources, Boating
Improvement Fund.
6. The County shall pay to the Contractor for the
performance of the contract, the sum of Forty-four Thousand
Dollars ($44,000) and shall further be paid the sum of One
Thousand Dollars ($1,000.00) from the FKARA upon completion by

Contractor and acceptance by County and FKARA, subject to terms
and conditions of this Agreement.
7. The Contractor shall also certify to the County and the
FKARA, that the project was compelted as specified in this
Agreement and Job Specification.
8. The attached Specifications together with this Agreement
form the contract and they are as fully a part of this contract

terms of the agreement control.
IN WITNESS WHEREOF, the parties p.ereto have executed this
Agreement as of the day and year first above written.
