RESOLUTION RESCINDING RESOLUTION NO. 085-1985
AND UPHOLDING THE DECISION OF THE BOARD OF
ADJUSTMENT OF MONROE COUNTY, FLORIDA, WITHOUT
PREJUDICE, AND DENYING THE REQUEST OF JOSEPH
ELKINS AND ROBERT WORTHEY TO REVERSE THE
DECISION OF THE BOARD OF ADJUSTMENT OF MONROE
COUNTY FLORIDA, DENYING THEIR REQUEST FOR A
VARIANCE TO CONSTRUCT A DOCK 340 FEET IN
LENGTH.
WHEREAS, on March 20, 1985, the Board of County Commis-
sioners of Monroe County, Florida, sitting as the Board of
Appeals, passed and adopted Resolution No. 085-1985, and
WHEREAS, the Board now wishes to rescind said Resolution in
order to correct scriveners errors, and
WHEREAS, on November 9, 1984, the Board of Adjustment of
Monroe County, Florida, denied a request for a variance to
construct a dock 340 feet in length on the following described
property:
A tract of land in a part of Government Lot 1, Section
15, Township 67 South, Range 27 East, Sugarloaf Key,
Monroe County, Florida. Zoned GU. Old State Road 4-A.
WHEREAS, Joseph Elkins and Robert Worthey have duly appealed
said decision to the Board of County Commissioners of Monroe
County, Florida, sitting as the Board of Appeals, and the Board
having reviewed the transcript of the November 9, 1984 hearing,
having considered the argument of all parties present wishing to
speak on the matter, and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That Resolution No. 085-1985 is hereby rescinded.
2. That the November 9, 1984, decision of the Board of
Adjustment of Monroe County, Florida, be, and the same is hereby
upheld.
3. That said Joseph Elkins and Robert Worthey be, and they
are hereby denied a reversal of the decision of the Board of
Adjustment of Monroe County, Florida, denying their request for a
variance to construct a dock 340 feet in length on the above-
described property.
4. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a
certified copy of this resolution by certified mail to said Field
Representative, Post Office Box 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, at a
regular meeting of said Board held on the 10th day of May, A.D.
1985.
