RESOLUTION NO. 178-1985
RESOLUTION REMANDING THE REQUEST OF THE FIRST
NATIONAL BANK OF SOUTH MIAMI, TRUSTEE, TO
REVERSE THE DECISION OF THE ZONING BOARD OF
MONROE COUNTY, FLORIDA, DENYING A CHANGE OF
ZONING, BACK TO THE ZONING BOARD FOR FURTHER
DETERMINATION.
WHEREAS, on February 28, 1985, the Zoning Board of Monroe
County, Florida, denied a request for a change of zoning on the
following described property:
A portion of the part of Lot 42 lying Northerly of the
former Florida East Coast Railway as shown on the Model
Land Company Plat (Surveyed by P.F. Jenkins) and
recorded in Plat Book 1 at Page 68, said parcel also
being shown on plat of Buttonwood Shores, Plat Book 3,
Page 3, of said Public Records as "This Tract is Not a
Part of the Plat". Said property located in Section
28, Township 61 South, Range 39 East. Key Largo.
Located on U.S. Highway #1 and East Shore Drive.
WHEREAS, The First National Bank of South Miami, Trustee,
has duly appealed said decision to the Board of County
Commissioners of Monroe County, Florida, sitting as the Board of
Appeals, and the Board having reviewed the transcript of the
February 28, 1985 hearing, having considered the argument of all
parties present wishing to speak on the matter, and all premises
considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the February 28, 1985 decision of the Zoning Board
of Monroe County, Florida, denying a change of zoning be, and the
same is hereby remanded back to the Zoning Board to make a
determination as to whether or not a zoning change was justified
irrespective of what uses are to be made of any rezoned property.
2. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a
certified copy of this resolution by certified mail to said Field
Representative, Post Office Box 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, at a
regular meeting of said Board held on the 19th day of June, A.D.
1985.
