RESOLUTION UPHOLDING THE DECISION OF THE
ZONING BOARD OF MONROE COUNTY, FLORIDA,
WITHOUT PREJUDICE AND DENYING THE REQUEST OF
RUTH H. BATEMAN TO REVERSE THE DECISION OF
THE ZONING BOARD OF MONROE COUNTY, FLORIDA,
DENYING A CHANGE OF ZONING FROM RU-1 TO BU-2Q
WITH A BU-2B
WHEREAS, the Zoning Board of Monroe County, Florida, on
December 21, 1983, denied a change of zoning from RU-1 to BU-2Q
with a BU-2B on the following described property:
Lot 2, Block 4 First Addition to Lida Subdivision, as
recorded in Plat Book 4, Page 103, and located in
Section 1, Township 66 South, Range 32 East. Marathon.
WHEREAS, Ruth H. Bateman has duly appealed said decision to
the Board of County Commissioners of Monroe County, Florida,
sitting as the Board of Appeals, and the Board having reviewed
the transcript of the December 21, 1983 hearing, having
considered the argument of all parties present wishing to speak
on the matter, and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the decision of the Zoning Board of Monroe County,
Florida, on December 21, 1983, denying a change of zoning from
RU-1 to BU-2Q with a BU-2B as requested by Ruth H. Bateman be,
and the same is hereby upheld.
2. That the said Ruth H. Bateman be, and she is hereby
denied a reversal of the decision of the Zoning Board of Monroe
County, Florida, denying a change of zoning from RU-1 to BU-2Q
with a BU-2B on the above described property.
3. The Clerk of the Board of County Commissioners of
Monroe County, Florida, is hereby instructed to forward a
certified copy of this Resolution to the Secretary, Department of
Community Affairs, 2571 Executive Center Circle, East,
Tallahassee, Florida 32301.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 6th day of
