RESOLUTION NO. 331 -1984
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, has received a Petition for acation of a Drainage
Easement filed by Robert J. Paterno and Mary Dell Paterno, which
Petition pertains to an easement centrally located on their
property in Key Haven, and
WHEREAS, Robert J. Paterno and Mary Dell Paterno have
granted a replacement Easement along the Southwesterly edge of
the property upon which the present easement is located, and
WHEREAS, the adjacent property owner has advised the Board
in writing that he has no objection to the relocation of the
drainage easement as proposed by the Petitioners, and
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, desires to renounce and disclaim any right of the County
and of the public in and to the hereinafter described drainage
easement, and
WHEREAS, due notice has been published and a public hearing
has been held regarding this action, and
WHEREAS, at said public hearing no objections were made to
renouncing and disclaiming of any right of the County and of the
public in and to the hereinafter described drainage easement,
now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that said Board hereby renounces and
disclaims any right of the County and the public in and to the
drainage easement on the following described property:
All of Lot 9 and a part of Lot 8, Block 2, KEY HAVEN
TENTH ADDITION as recorded in Plat Book 5 at Page 114
of the Public Records of Monroe County, Florida, and
more particularly described as follows: BEGIN at a
concrete monument at the Northeast corner of said Lot 9
and run thence Southwesterly along the curved right-of-
way of Driftwood Drive, concave to the Northwest and a
radius of 712.66 feet, for an arc distance of 10 feet
to a concrete monument at the end of said curve and the
beginning of a second curve; continue southwesterly
along the curved right-of-way of the said Driftwood
Drive, said second curve being concave to the Southeast
and a radius of 350 feet, for an arc distance of 100
feet to a concrete monument; thence run S 490 05' 13" E
and radial to the said second curve, for a distance of
135 feet to the Mean High Tide of Cypress Lake; thence

run Northeasterly and along the Mean High Tide of the
said Cypress Lake for a distance of 73 feet, more or
less, to a point on the dividing line between Lots 9
and 10 of the said "Block 2; thence run N 330 31' 14" W
along the line between said Lots 9 and 10 for a
distance of 134 feet, more or less, back to the Point
of "Beginning.
"BE IT FURTHER RESOLVED "BY SAID "BOARD that the Clerk of said
"Board be, and he is hereby ordered to published notice of this
action in accordance with the provisions of Chapter 336, Florida
Statutes.
