Resolution 401-1984 RESOLUTION NO. 401 -l984 A RESOLUTION OF THE ~OARD OF COUNTY COMMIS- SIONERS OF MONROE COUNTY, FLORIDA, RELATING TO THE CRIMINAL JUSTICE FACILITIES SALES TAX. WHEREAS, the Monroe County voters have, at the general election on November 6, 1984, approved the imposition of a six-month, one percent (1%) sales tax, as authorized by Chapter 83-355, Laws of Florida, as amended by Chapter 84-324, Laws of Florida; and WHEREAS, the Department of Revenue has been notified of the results of that election, and has also been given a copy of the Ordinance levying the tax; and WHEREAS, it is the intent and purpose of Monroe County to utilize the proceeds of the tax only for the purposes enumerated in Chapter 83-355, above, as amended; and WHEREAS, Section 4 of Chapter 83-355 requires the governing authority of Monroe County to certify to the Department of Revenue that it has entered into a contract for the purposes enumerated in that law, and to include therewith a schedule of disbursements to satisfy such contract. NOW, THEREFORE, ~E IT RESOLVED ~Y THE ~OARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: 1. That this Resolution be, and the same shall constitute the certification by the governing authority of Monroe County, Florida, to the Florida Department of Revenue of the facts enumerated herein below. 2. The ~oard of County Commissioners of Monroe County, Florida, as the governing authority has entered into a contract for the purposes enumerated in subsection (2) of Chapter 83-355, Laws of Florida. 3. The attached Exhibit "A" constitutes the schedule of disbursements to satisfy the design and construction of the County criminal justice facility. 4. The County ~udget Officer, the Clerk and the Auditor of the ~oard of County Commissioners of Monroe County, Florida, be, and the same are hereby directed to establish and set aside a EXHI"BIT "A" MONROE COUNTY, FLORIDA CRIMINAL JUSTICE FACILITY SCHEDULE OF DIS"BURSEMENT Pursuant to the requirements of Section 4, Chapter 83-355, Laws of Florida, Monroe County submits its Schedule of Disburse- ments of the proceeds of the sales tax collected by the Depart- ment of Revenue, which shall commence with the first disbursement in March, 1985 to include all proceeds included through February, 1985, and the last disbursement to include the proceeds collected in June, 1985. All disbursements shall be made to the "Board of County Commissioners of Monroe County, Florida, in care of the Clerk of the Circuit Court, Monroe County Courthouse, 500 Whitehead Street, Key West, Florida 33040. First disbursement - The proceeds of the one percent sales tax collected during the months of January and February, 1985, and thereafter in March and each month through June, 1985, the proceeds of the one percent sales tax collected by the Department of Revenue for the next proceeding month. Each disbursement shall be reduced by the amount of the cost of administration as determined by the Department of Revenue on a pro rata basis as the same shall coincide with this disbursement schedule. The anticipated revenues of this sales tax which shall accrue to the benefit of the Monroe County Criminal Justice Facilities is approximately $2,800,000.00, which, if the estimated is realized the Monroe County disbursement schedule would be as follows: First Disbursement: Second Disbursement: Third Disbursement: Fourth Disbursement: Fifth Disbursement: Sixth Disbursement: Seventh Disbursement: Eighth Disbursement: Ninth Disbursement: Tenth Disbursement: Eleventh Disbursement: Twelfth Disbursement: Thirteenth Disbursement: Fourteenth Disbursement: Fifteenth Disbursement: March 1985 April 1985 May 1985 June 1985 July 1985 August 1985 September 1985 October 1985 November 1985 December 1985 January 1986 February 1986 March 1986 April 1986 May 1986 In the event the sales tax produces more or less than the disbursements, the same will be reduced or increased on a pro rata basis. separate account within the frame work of the laws pertaining to County funds, a trust account to be known as the Monroe County Criminal Justice Facility Tax Trust Fund, and shall deposit therein all proceeds received from the Department of Revenue from the one percent (1%) six-month sales tax adopted at referendum on November 6, 1984, and to expend therefrom these funds only for the purposes enumerated in Chapter 83-355, Laws of Florida. EE IT FURTHER RESOLVED that Monroe County shall hereafter provide the Florida Department of Revenue with such amended and supplemental certificates of contract and disbursement schedules as the further implementation of the purpose and intent of Chapter 83-355, above, shall require. EE IT FURTHER RESOLVED that a certified copy of this Resolu- tion and its attached Exhibit "A" be forwarded to: The Honorable Randy Miller, Executive Director, Department of Revenue, 202 Carleton Euilding, Tallahassee, Florida 3230l.
