Resolution 058-1982 RESOLUTION NO. 58 -1982 RESOLUTION OUTLINING THE DUTIES AND RESPONSIBILITIES OF THE MONROE COUNTY TOURIST DEVELOPMENT COUNCIL; MAKING PROVISIONS FOR THE HANDLING OF BUSI- NESS RELATING TO THE TOURIST DEVELOP- MENT COUNCIL AND PROVIDING FOR WAYS AND MEANS TO AMEND THE SAME. WHEREAS, under Florida Statutes 125.0104, the County Commis- sion has passed an ordinance establishing a Tourist Development Council and providing for the levying of a tax in accordance with said Statute, and, WHEREAS, the County Commission has appointed and designated, as provided in said Statute, for a Tourist Development Council, and, WHEREAS, the Board of County Commissioners of Monroe County deems it advisable to delegate certain duties and responsibilities to the Monroe County Tourist Development Council so as to facilitate the work of said council and the purpose of the said ordinance and Statute, and, WHEREAS, provisions should be made to provide for the re- commendations in an orderly fashion to be made by the aforesaid council, and, WHEREAS, nothing herein shall be deemed as a deprivation of the Mayor and County Commission's prerogative legally to enter into contracts, and, WHEREAS, all of the aforesaid is done to add to the efficiency of this development plan and to the purposes which 1S set forth 1n both the State Law and the aforesaid ordinance, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MON- ROE COUNTY, FLORIDA, that the following duties, responsibilities and restrictions are hereby created; to-wit: 1. Administrate the tourist development plan in accordance with the directives and policies established by the Board of County Commissioners for the Fiscal Year 1981-1982. 2 . 2. Develop and administer an annual fiscal budget approved by the Board of County Commissioners for the implementation of the aforesaid plan and to administer the 1981-82 Fiscal Year Tourist Development Budget to be approved by the Board of County Commissioners upon implementation subject to any budget amendments. 3. Develop an annual marketing and advertising plan, and budget, for the 1981-82 Fiscal Year, and submit the same to the Board of County Commissioners for approval. Said plan to be ad- ministered, within the confines of the Budget, as approved by the Board of County Commissioners. 4. Select and employ personnel and prescribe their duties, subject to the provisions of the Monroe County Personnel Policies and Procedures, with the concurrence of the Board of County Commis- sioners, as deemed necessary for the proper administration of the tourist development plan and performance of the duties and re- sponsibilities defined herein; 5. Prepare and submit evaluation reports and recommendation to the Board of County Commissioners concerning the administration of the tourist development plan at the conclusion of each "seasonal" marketing and advertising compaign, and reports to be submitted on rtf._ Ly I . and Of! Conduct preliminary negotiations and submit proposed contracts for approval by the Board of County Commissioners as deemed necessary for the proper administration of the tourist development plan; 7. Insure coordination and cooperation with all appropriate County Departments for the effective administration and completion of all tourist development programs; 8. Insure that all financial activities and accounting pro- cedures concerning the administration of the tourist development plan are in compliance with the requirements of applicable local, state, and federal laws; 9. Perform such other duties as may be required from time to time, by the Board of County Commissioners as is reflected in the amendments to this resolution. 3 . BE IT FURTHER RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS that they will review, from time to time, the resolution and the duties and obligations reflected herein to determine whether or not said duties and responsibilities have been performed satisfact- orially in the judgment of the Board of County Commissioners. BE IT FURTHER RESOLVED that except as is set forth herein and also ln Ordinance No.9-1981, that the Board of County Commis- sioners do not divest themselves of any of the duties and powers contained in the aforesaid ordinance and the law hereinbefore recited. Passed and adopted by the Board of County Commissioners of Monroe County, Florida, at a regular meeting held on the 26th day of January, A.D. 1982.
