Resolution 075-1982 HESOLPTION no. 75 -1982 T\TBEPEAS, the BOARD OF COU}TTY COY~HI SS I(WERS OF ~ml'TROE COUNTY, FLORIDA, has received an application from RICHARD P. KERWICK and ':\THEHEAS, in compliance with State Statute, it is necessary as part of the permitting procedure to read the following Biological Assessment into the Record, as follows: This is a partial after-the-fact permit to perform work that was unauthorized by the original permit (#44-24226-5E). This work included the excavation of a 48' x 16' boat basin where a 10' x 16' boat ramp was originally permitted and a 40' length of shoreline that was filled for the purpose of creating a beach where a seawall was orginally permitted. Aoditionally, the riprap which was to be originally placed was not, and is now being applied for. A total of approximately 150 cubic yards were excavated for the boat ramp of whicn all but about 30 were excavated above MEW. Approximately 5 cubic yards of rock will be needed for the riprap revetment (not 600 as indicated). An undetermined amount of riprap will be needed to complete riprap placement along the entire seawall. The project site was recently bulkheaded for all but 40' of the shoreline. This bulkhead extends waterward for a distance of 5 to 10 feet from the dropoff to the peripheral channel. A small amount of riprap was placed at the bulkhead toe. ",There the bulkhead was not constructed, beach sand has been placed. From an historical standpoint the project uplands were created from the excavation of the neripheral channel and finger canals and consequential placement of spoil on surrounding areas. A residential subdivision was created that is presently 10 to 15 percent developed. Thi subdivision is located on a shallow, semi- enclosed, low energy embayment. mhis particular site is located near the south end of the subdivi- sion. The shoreline is oriented to the west and naturally occurring mangrove wetlands occur almost immediately to the south. Uplands in the general area are vegetated only by pioneer species and shorelines here tend to be somewhat eroded and essentially unvegetated. The applicant owns and lives in a recently construc- ted house on the property. ~he applicant's property has about 287' of open-water shoreline that had eroded back from the edge of a peripheral channel. This channel is about 40' -45' wide and probably about -8' to 10' ~"LT![ in depth. ~he width of the eroded shelf in the area to be filled varies from about 10' to 15'. The eroded area consists of marl, rock rubble and boulders. Intertidal and subtidal vegetation on this shelf is limited to Batophora over firmer substrate. Resolution Richard P. Kerwick Seawall and Boat Basin :0 age Two Scattered small buttonwoods (Conocarpus erecta) are present just above MHW along this shoreline which does not accumulate floating organic debris because of local conditions. The benthic community waterward of the peripheral channel consists of hard bottom rock-algae-sponge communities with some seagrasses. Depths here vary from -1' to -3' MLW. ~he primary impact from this project has already been realized from the excavation of the boat basin. The excavation of this basin eliminated a small amount of existing benthic biota and created a small discontinuity. The existing biota here was, however, at somewhat less than maximum level in terms of productivity and diversity. Also, debris accumulation is not a problem due to the shoreline/wind orientation. As a whole, the benefits derived from this project (habitat creation and wave energy dispersion from riprap placement along the seawall) should offset the negative impacts already realized. The construc- tion of the rip rap revetment should also serve to discontinue harmful sedimentation that is presently occurring. Zoned FU-1. INTRonUCTION & DISCUSSION: This application is to be reviewed by the Board of County Commissioners in accordance with Chapter 19-111 (a) (5) of the Monroe County Code. On January 2Q, 1980, the Board of County Commissioners approved the construction of a 287 ft. concrete seawall, with rip-rap at its base, and a hoat ramp measuring 10 ft. x 16 ft. A follow-up inspection by the Department of Environmental Regulation revealed that a 247+ ft. concrete seawall with insufficient rip-rap, and a boat ramp/basin (16 ft. x 48 ft. x -4 to -5 ft.) were constructed. Also, a 40 ft. long sandy beach was created in the southeast portion of the property where part of the seawall was to be. The applicant is requesting after-the-fact approval for the boat basin and the sandy beach. In addition, the applicant would like to place more rip-rap at the toe of the seawall and ahove the MHW line of the beach. Accqrding to the DER report, approximately 150 c.y. of material was excavated from the boat basin (120 c. y. below ~JHW), approximately 5 c.y. of rip-rap will be placed behind the beach and an undeter- mined amount of rip-rap will he deposited at the seawall base. The attached DER report discusses this project in greater detail and should be read for additional information. FVALPATION: Because of the orientation of the boat basin, water quality caused by seagrass debris should not be a problem. Intertidal and subtidal vegetation on this shelf is limited to Batophora over firmer substrate. Scattered small buttonwoods (Conocarpus erecta) are present just above MHW along this shoreline which does not accumulate floating organic debris because of local conditions. The benthic community waterward of the peripheral channel consists of hard bottom rock-algae-sponge communities with some seagrasses. Depths here vary from -I' to -3' MLW. D. The primary impar.t from this project has already been realized from the excavation of the boat basin. The excavation of this basin eliminated a small amount of existing benthic biota and created a small discontinuity. Tqe existing biota here was, however, at somewhat less than maximum level in terms of productivity and diversity. Also..... debris accumulation is not a problem due to the shoreline/wind orientation. As a whole, the benefits derived from this project (habitat creation and wave energy dispersion from rip rap placement along the seawall) should offset the negative impacts already realized.
