RESOLUTION NO. 284.-1982
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, WAIVING THE PROVISIONS
OF SECTION 19-132.1 OF THE CODE OF ORDINANCES OF
MONROE COUNTY, FLORIDA, AS IT PERTAINS TO THE
CONSTRUCTION OF A TENNIS COURT UPON LOTS 41 AND
42 OF &~NDED AND EXTENDED PLAT OF YACHT HARBOR
ISLfu~D, AND DIPillCTING THE BUILDING DEPARTMENT TO
ISSUE A BUILDING PEID1IT UPON THE FILING OF A
PROPER APPLICATION TOGETHER WITH THE PAYMENT OF
REQUIRED FEES.
WHEREAS, Robert E. Richardson, the owner of Lots 41 and 42 of
Amended and Extended Plat of Yacht Harbor Island, according to the
plat thereof, recorded in Plat Book 3, page 154 of the Public Records
of Monroe County, wishes to construct a private tennis court or
courts upon the said lots, and
WHEREAS, the said lots are located on the opposite side of the
road upon which is constructed the residence of the said Robert E.

Richardson, and there is no building presently constructed or
contemplated to be constructed upon the said lots, and
WHEREAS, Section 19-132.1 of the Code of Ordinances of Monroe
County, Florida, prohibits the construction of an accessory building
or structure on property upon which there is no principal building,
and
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, finds that Section 19-132.1 of the Code of Ordinances of
Monroe County, Florida, should not be applied in this case, and
therefore waives the provisions of that section as it pertains to
the lots hereinabove mentioned, now, therefore,
BE IT RESOLVED, by the Board of County Commissioners of Monroe
County, Florida, that the provisions of Section 19-132.1 of the Code
of Ordinances of Monroe County, Florida, shall be, and hereby are
waived as they apply to lots 41 and 42, Amended and Extended Plat
of Yacht Harbor Island, according to the Plat thereof, recorded in
Plat Book 3, page 154 of the Public Records of Monroe County, Florida,
for the construction of a private tennis court facility by Robert E.
Richardson, and the director of the County Building Department is
hereby authorized to issue a building permit for the said tennis
facility, upon the filing of a proper application therefore by
Robert E. Richardson, or his agent, together with the required
filing and permit fees.
ADOPTED at a regular meeting of the Board of County Commissioners
of Honroe County, Florida, held on the 1st day of
November
