WHEREAS, the Florida Department of Community Affairs and Monroe County, Florida have entered into a Memorandum of Agreement relative to the development of a Land Use Map for Monroe County and a provision i• s therein providing f.Or such funding from the State of Florida for said purpose, and WHEREAS, the 'parties in said •Memorandum of Agreement have entered into and arrived at a work program and other relative matters concerning the development of the Land Use .Map and its component parts, now, therefore, _ BE IT RESOLVED BY THE MAYOR AND COUNTY COMMISSION OF MONROE COUNTY, FLORIDA, that: 1. AOP By - ♦' Au mey s Ofee $ MEMORANDUM OF AGREEMENT This agreement is being entered into this 12th day of December by and between the Department of Community Affairs (Department) and Monroe County to provide mutual cooperation and to make revisions to the County Comprehensive Plan and land development regulations including a land use map and capital facilities program, associated with the public services plan in order to ensure that future growth in the Florida Keys will be coordinated and well planned. WHEREAS , Monroe County has been declared an Area of Critical • State Concern, pursuant to Section 380 . 05 , Florida Statutes , and therefore, must prepare and submit their Comprehensive Plan and land development regulations to be approved by the Department in accordance with Section 380 . 05 , Florida Statutes , as amended by Chapter 83-308 , Laws of Florida. WHEREAS , the Department , as the State Land Planning Agency, is required to provide assistance to local governments within _ designated Areas of Critical State Concern. WHEREAS , Monroe County has shown a commitment to promoting sound comprehensive planning by, adopting a moratorium on process- ing major development projects that have not received preliminary approval until such time as these planning mechanisms are in place . WHEREAS , both the Department and Monroe County have commit- ted to providing staff and resources to support this cooperative planning effort . NOW, therefore , the parties mutually agree as follows : Monroe County and the Department will execute the work pro- • program attached herein as an addendum, outlining the process by which the County ' s Comprehensive Plan, including the . land development regulations , will be brought into compliance with Florida Law. The Department agrees to release funds to Monroe County to support this planning effort totalling $200 , 000 for the 1983-1984 • • fiscal year . As the Department determines that the County has made satisfactory progress towards accomplishing the objectives and tasks identified in the work program, funds will be released to Monroe County through a mutally agreed upon scheduled of payment (schedule attached as Addendum I) . The Department and the County will mutually develop scopes of work for use ih obtaining consultant services for the purpose of achieving specific tasks and objectives identified in the work program. The County will be responsible for selecting consul- tant (s) , performance monitoring and delivery of work products . All work products produced by consultants , County staff or the Department staff will be transmitted and reviewed by both the Department and Monroe .County prior to any final determination of product sufficiency . The Department agrees that their work pro- duct review will be based upon the method set forth in "Monitor- , ing Procedures - Monroe County Planning Program" (Document attached as Addendum II) . Further , the Department recognizes the necessity of an expeditious review, therefore, the Department agrees that all reviews , _except- Task IV D . 4 . 2 of the County ' s Work Program, will be completed and the County notified within fifteen C15) working days of the Departments receipt of the product . The Department agrees to have completed revisions to Chapter 27F8 . 03 , Florida Administrative Code , Principles for Guiding Development no later than March , 1984 .- The principles will pro- vide the basis by which the Comprehensive Plan, including the land development regulations , will be reviewed and approved by this Department pursuant to Section 380 . 05 , Florida Statutes , as amended by Chapter 83-308 , Law - of Florida. Should said revi- sions require the amendment of the County' s approved work program the Department will notify the County in writing of all required revisions and shall grant- amendments to the time frame for performance set forth under this agreement . The 1983 amendments to Section 380 . 05 , Florida Statutes , give the Department the authority to approve the Comprehensive Plan for any local government within an Area of Critical State Concern . These amendments require that affected local govern-. ments submit their Comprehensive Plan and land development regu- lations to the Department no later than January 1 , 1984 . The Department agrees to grant to Monroe County an extension to this deadline until such time as the revisions to the Comprehensive Plan and land development regulations are completed and adopted . by Monroe County as specified under the approved work program or 'no later than. December 1, 1985 . The Department and Monroe County agree to insure that throughout the planning process adequate opportunity is given the public to participate the formulation of these plans . At a ' minimum, this participation should be accomplished through public hearings and workshops and the issuance of monthly joint press releases . The Department assures the County that compliance with its approved work program shall be the basis for review and approval of all work products . Upon completion and adoption of the revisions to the Compre- hensive Plan specified in the approved work program including the land development regulations , the Department will determine whether these documents comply 'with- the Principles for Guiding Development . • If the Department finds that the Comprehensive Plan, includ- ' ing' the land development regulations , do comply with the, Prin- ciples for Guiding Development , the Department will by rule , - approve such pursuant to Section 380 . 05 (6) , Florida Statutes . Upon the Department ' s approval of the Comprehensive Plan and land development regulations a one year phase will begin . During this 12-month phase the 'Department will monitor the County ' s implementation of said Plan and regulations . If at the conclusion of the monitoring period the Department determines the administration of these regulations is adequate to protect the State and regional interest , proceedings will be initiated to remove Monroe County from the Area of Critical State Concern designation. , The parties may amend this Agreement by mutual consent , in writing . This agreement shall become effective on the date it has been signed by both parties . It will remain in effect until mutually dissolved. The Department and County agree , if necessary to solicit funding during the 1984 Legislature Session to complete this comprehensive planning effort. The "County - agrees that the major tasks described in the work program will be completed no later than the following schedule : (a) TASK I February 15 , 1984 ; (b) TASK II May 31 , 1984 ; (c) TASK III September 30 , 1984 ; and (d) TASK IV January 1 , 1985 Both parties reserve the right to amend this schedule when sufficient evidence as to the desirability of said change can be presented . The parties may only amend this schedule by mutual written consent . The Department reserves the right to develop a Comprehensive Plan and land development regulations based on the work program, to be reviewed by the Governor and Cabinet at such time as the Department determines that. the County is not satisfactorily adhering to the above work schedule . A fourth payment of $50 , 000 upon the satisfactory completion of all work products associated with Task III of the work program as determined by the Department . • • • • • • • • • • ADDENDUM II • Monitoring Procedures - Monroe County Planning Program It is imperative that the procedure utilized for review and approval of the County' s work tasks under the Growth Management Planning program be carried out in an expedient fashion. This is particularly true in light of the highly constrained time frame within which the planning program is operating . The following procedure is established to ensure proper administrative review and certification of work products developed under the auspices of the County ' s Growth Management Program. • The Department of Community Affairs ' local planning coordinator shall review and certify the acceptability of technical memoranda and other work products developed under individual subtasks .within the work program. Written letters of certification from the coordinator will be required and will provide documentation of subtasks completion. These certification letters along with copies of the work products will be submitted to DCA, Tallahassee with supporting invoices in order to justify payment . Major work tasks identified below will be submitted to DCA in Tallahassee for their review and approval in conjunction with the DCA' s Planning Coordinator Review. Ultimate approval , however , would be the responsibility of DCA' s Tallahassee office . All reviews and subsequent approvals from DCA shall be in written form. Review of all major work tasks except IV D . 4 . 2 (which • will reviewed as per Florida Statutes (45 days) would be completed within fifteen (15) working days of receipt of said task in the DCA Tallahassee office . All .subt,asks under each of the above major work items will be reviewed by the DCA' s planning representative in the Keys . It is assumed t-hat if all work performed under individual sub-tasks is acceptable then, barring any major departure from these subtasks , • the major products developed should also be acceptable . ( 1) The proposed process has several advantages : A) The process is time efficient . Memoranda developed under individual sub-tasks will be reviewed by members of DCA who are most familiar with the County' s planning process . Turn around time between submittal of the work product for review and receipt of approval will be mini- mized , thereby avoiding delays between completion of one sub-task and commencement of another . B) The procedure facilitates a "hands on" participation by State DCA planners . In so doing, the process will avoid costly revisions . With State participation from the outset , it is less likely that the final work product of a sub-task will be found unacceptable . This in turn minimizes the potential for costly re-writes and sub- sequent time delays associated with these . C) Since the local DCA representative is in the position of ' coordinating the planning program this monitoring pro- cedure supports and facilitates that role . D) Where major work products are involved the monitoring process sets forth a combined review process by both local and Tallahassee representative of DCA. This review covers major sections of the work program in- cluding the most significant : i . Methodologies & Assumptions 2 . Projections 3 . Goals , policies and objectives 4 . Plan document itself E) Finally , this procedure ensures that each sub-task product is reviewed and approved providing protection to the County from processing to the point of developing a major work product based upon a synthesis of sub-task products that could be- found unacceptable to the State . It is the County ' s belief that this monitoring procedure will ensure the integrity of the process , allow the State a constant monitoring capability , and accomplish both within an acceptable time frame at a minimum of cost . Included in this review will be the determination of current trends relating to population growth and location, economic activities , land use patterns and methods of "providing necessary public infra- structure and improvements to meet existing demand . Further , an analysis of Monroe County ° s critical and unique natural environmental features will be conducted to identify issues , problems and natural areas that are facing development pressure . These analyses will • provide the basis for evaluating the existing growth trend in Monroe County to be undertaken in Task II . I .A. Identify , qualify and .evaluate existing Environmental Characteristics in Monroe County . Sub tasks • 1 . 1 Identify agencies , organizations and individuals with expertise in the area of natural environmental features of the Florida Keys . Solicit participation . 1 , 2 Identify , review and process all available graphic and narrative data on Florida Keys environmental features . 1 . 3 Identify and describe the categories of natural features to be analyzed as well as the degree of resolution of the • analysis . 1 . 4 Identify and describe the location and characteristics of endangered species habitat in t-he Florida Keys . 1 . 5 Develop a map and supporting narrative detailing specific environmental features and habitat in the Florida Keys . General Approach Agencies identified under Su.btask 1 . 1 include , but are not limited to : (1) Monroe County Biologists , (2) Representative from Endangered Species Office and Environmental Services Branch of Fresh Water Fish and Game Commission, (3) Florida Office of Coastal Management (DER) , (4) Nature Conservancy , • (5) Monroe County Commission • (6) U. S . Fish and Wildlife Service , (7) Private Individuals • (8) Army Corps of Engineers , (9) Florida Departmentof Environmental Regulation • (10) Citizens Groups , (11) Department of Community Affairs , (12) South Florida Regional Planning Council Utilizing the County staff , and the preceding group , data- on natural environmental features of the area will be identified , reviewed and analyzed as to coverage , detail and utility to the project . The data will be . used to identify and 'describe a functional set of categories of environmental features to be utilized in the planning program. Preliminary analysis has identified the following classifications of natural features : ( 1) • (1) Cleared/disturbed lands (2) Tidal wetlands • (3) Impounded saltwater. wetlands (4) Freshwater wetlands • (5) Slash pinelands (6) Tropical hardwood hammocks (7) Beaches and dunes (8) Shallow water marine habitat (sea grass beds/coral reef) For each of the above environmental categories , a narrative description of the following will be prepared : • (1) Function and Utility - The contributions of the category to the Keys environment and the characteristics that make it valuable and unique will be described. (2) Sensitivity - The ability of each category to absorb development and still maintain the natural functions (described above) will be assessed : Additionally, areas of particular concern (APC ' s) should be identified which may include portions of the above categories which because of certain unique qualities warrant special attention or management strategies . A 1 : 2000 scale map will be developed to graphically portray the boundaries of each of the environmental categories including endangered species habitat . All mapped information will be checked for accuracy and where necessary ground-truthing may be conducted . The number of individual maps will vary depending upon the ability to depict- several categories with cartographic clarity . County Contribution The County will provide a listing of agencies , organizations and individuals having, knowledge 'or expertise concerning environmental features of the Florida Keys . These entities will be contacted and their assistance and input solicited_ by County personnel . The County will review and categorize the necessary level of resolution for the map series , will develop and provide copies of the base map at the 1 : 2000 scale . Working with specialists on the Keys environment the County , when necessary , will provide staff support for any ground-truthing that becomes necessary . Members of the Planning and Zoning Department will assist in the graphic and narrative analysis of ecological area and habitat . State Contribution • The State of Florida should be prepared to assist in identifying specialists with knowledge of the local government . State assistance will be especially valuable for ensuring the cooperation of the State and Federal agencies identified in Subtask 1 . 1 . Refinement of land use acreage figures developed from the Department of Community Affairs existing land use maps will require 'the use of the State ' s computer' resources or the development of a similar system (Apple II or equivalent) in the County . I . B . Existing Land Use Inventory 1 . 1 Transportation System Capacities Sub tasks 1 . 11 Review system inventory including the Monroe County Road System Atlas , Listing and Evaluation as well "as other studies , data and plans developed by Monroe County, the State of Florida or other parties . 1 . 12 Identify and develop data needs to meet any deficiencies revealed in 1 . 11 . 1 . 13 Identify: choke points in the existing transportation network. (2) 1. 14 Summarize all . of the above and develop a narrative description and series of maps depicting the existing and committed transportation network, LOS , conditions affecting the transportation network (choke points , etc . ) and proposed 'improvements (not yet committed) . General Approach An overview of the following components of the road network in Monroe County will be undertaken to identify road conditions , capacities and deficiencies for : A. Card Sound Bridge B . County - 905 . C . U . S . 1 'D . Key Deer Blvd. /Wilder Road All data , reports and plans concerning Monroe County ' s road network will be reviewed and compared . Included in this review will be the analysis of goals , policies and assumptions set forth in the afore- mentioned data . These assumptions and policies will be reviewed to ascertain their compatibility and consistency with development of a transportation and planning program for the Florida Keys . Existing traffic• counts , trip generation rates , data on intersection capacities and movement . This analysis will identify roadway standards and capacities with a special emphasis on the identification of areas of insufficient capacity and congested traffic flow (choke points) . Out of this analysis a listing of supplementary data needs for the planning program will be developed and methods to obtain this data will be identified . The existing transportation system coupled with the committed system improvements will provide the basis from which to analyze impacts of various scenarios developed at a latter stage in the planning process . The availability of design and construction funds along with any system improvement priorities and the timin-g of each improvement will define • the components of the committed network. Out of this analysis , the County will develop the following maps at a 1 : 2000• scale : z_ • • 1) Existing and committed transportation network (including intersections) 2) past , present ADT ' s 3) Transportation• network capacity deficiency or sufficiency 4) Existing level of service by classification • Additionally , the County will develop a technical report summarizing the above maps and activities . This report will discuss present and proposed standards for trip generation , LOS and road classification as well as any modeling processes used in. the County (if applicable) and the underlying assumptions used to guide the work element . Analysis of the peak loading from tourism may need to be carried out and identified in this report . County Contribution , Monroe County will provide the Road System Atlas , Listing and Evaluation, all previously developed data on road capacities and ADT' s , as well as other studies , data and reports complied by agencies , groups and developers . County staff will assist in the compilation and coordination of data acquisition and the analysis of policies and assumptions . Further , the County will provide base maps , at an appropriate scale , for the development of the aforementioned map series . County staff will provide their knowledge and expertise in the identification of additional data needs , the identification (3) • • of presently known system choke points and committed network improvements on County maintained roads . State Contribution The Department of Community Affairs through the Florida Department of Transportation should be prepared to provide input and technical assistance in the identification of committed network improvements under its jurisdiction, modeling processes used for the County ' s ADT ' s Level of Service both existing and projected development , future system plans (outside of committed projects) and standards for calculating trip generation . Additionally, the State will be requested to assist in providing data where deficiencies exist . Finally , if it becomes necessary , some additional traffic counts may be required in selected locations . Both the County and the State should work closely with the South• Florida Regional Planning Council in data acquisition and analysis . 1 . 2 Sub tasks 1 . 21' Identify land classifications to be utilized in this analysis and the coding system for their identification . 1 . 22 Develop and review an inventory of man-made land uses and publicly owned properties by planning sub-area . 1 . 23 Develop an acreage calculation for each of the selected land use classifications by planning sub-area . 1 . 24 Develop a map series and supporting narrative detailing developed/man-made land use characteristics and publicly owned properties by planning sub-area . 1 . 25 Develop and implement a land-use monitoring system utilizing building permits and Certificates of Occupancy . General Approach The County will identify general land use classifications to be utilized in aggregating information concerning existing land uses . These classifications will be derived from Land Use , Cover and Forms Classification System, developed by the Florida Department of Transportation. It is anticipated that certain specific land use classes may be lumped into a more generalized use category . A detailed analysis of existing information related to existing land uses in the County will be undertaken . Substantial data is currently available in „the form of an existing land use map series developed by the Department of Community Affairs (DCA) and reviewed by the County as to accuracy . Additionally , all properties currently owned by local , state and federal agencies will be identified and quantified . Boundaries of these areas will be shown graphically. All information developed in this work element will be quantified by acreage and disaggregated into planning sub-areas . . The ultimate product will be the identification of existing land use classifications by area and by planning district . Utilizing the above information, the following map (s) of existing land uses will be prepared on a County-wide basis : 1) General land use map of Monroe County a) Retail • b) Heavy business (industrial) c) Publicly owned properties/open space • d) Residential uses by type e) Transportation • (4) • 2) Zoning 3) Land Value and Structure Value • Plans from the Cities of Key West , Key Colony Beach, Layton and North Key Largo Beach will be evaluated for their potential impacts upon existing land use patterns and infrastructure in the County . County Contribution County staff will analyze and develop the land use categories to be displayed . Further , a ground-truthing map of developed characteristics . and associated acreage calculations will be provided by Monroe County . All additional refinement of this map series except any required computer applications can b.e carried out by the County . Base maps will be supplied by the Planning Department at the 1 : 2000 scale for all mapping under this element . State Contribution The State of Florida should be prepared to assist in the identification of land use data sources concerning Monroe County . This assistance • will include identification of State land use studies as well as local comprehensive plans from jurisdictions in the County where .said plans are not available at the local level . Up to date data on State owned lands will be supplied by the Board of 'the Internal Improvements Trust Fund including acreage , boundaries and anticipated acquisitions . Additional data shall be sought from other state agencies not under the Board ' s jurisdiction . Census , a figure of units and/or population served will be developed to graphically display the inventory and service group date developed under this subtask. Data will be presented both County-wide and by sub-area at a 1 : 2000. scale . Operation and maintenance costs will be reviewed for the past 3 to 5 fiscal years , depending upon data availability. Cost analysis for each service by district will be developed. Further , facility expansion. costs (capital improvements) will be identified and quantified for each acceptable increment of capacity expansion by public service . Data on planned or projected additions , including estimated costs , or deletions to facilities and services will also be obtained. Upon completion of the service inventory and the identification of the service population the development of level of service indicators and standards will be undertaken. This subtask will identify excess or deficient capacity for each service by planning sub-area . It is anticipated that the LOS standards will utilize relatively general indicators of capacity. • Even products of this work element will be coordinated with technical analyses developed under the previous work elements of Task Group One. County Contribution The County will provide current data concerning service districts used by public facility providers in the Florida Keys . Further , inventories of public services developed by County Planning staff will be provided along with maps that have been developed which show inventories of facilities , service districts and location of services . Census coupled with records maintained by service providers , the County will prepare an estimate of population or number of units served by individual service and by sub-areas . State Contribution The State of Florida should be prepared to undertake a study of sewage treatment alternatives in conjunction with proposed revisions to HRS regulation 10D-6 . Special attention should be given to the commercial fishing industry. Growth impacts upon productivity, li-festyle and location of commercial fishing will be analyzed . The projected trend growth, including population , employment , commer- cial and residential requirements will be utilized to identify addi- tional travel demands and their characteristics will be estimated and compared to the existing and committed transportation network as identified in work element 1 . 1 . Evaluation of network excess or deficient capacity will be made and system expansions will be identified by location, time frame and cost .. Impacts upon public facilities and services will be based upon popula- tion and employment projections by planning sub-area as compared against existing and programmed facilities . From this comparison an analysis of the adequacy of inadequacy of public facilities will be developed by service , location and time increment within the planning horizon. All work items to be undertaken will meet the requirements of Florida Statute 163 referencing Comprehensive Plan requirements . Additionally , all plan documents shall be required to address those portions of the Florida Administrative Code , particularly 27-F, that relate to the elements being prepared under this program. Documents being developed through this work program will not result in revisions of all required Comprehensive Plan elements under Chapter 163 provisions . Certain elements including Intergovernmental Coordination, Economic , Recreation & Open Space and Housing will be revised during the second year while the County is under the Implementation and Monitoring phase of this program. It is anticipated that most of the date acquisition and analysis work for these elements will be completed under this work program. The plan elements to be developed under this work program consist of : Transportation Element : This element will meet the statutory provisions of Chapter 163 particularly those pertaining to traffic and circulation plan requirements . Spepifically , the document will assess the traffic related, impactS of the growth management plan including specific identification of potential problem areas as well as alternatives (including cost) for mitigating these impacts . A set of transportation management and planning guidelines will be developed that are 'compatible with land use growth . Energy impacts of the transportation system will be briefly reviewed and addressed in this document . Land Use Element and Map : This element will consist of development strategies and development framework for land use growth in the County . A. Land Use Plan Map shall be developed which will be a general graphic representation of the Land Use element . The economic impacts of growth will be discussed in general terms in this element as will mechanisms for offsetting these costs . At a minimum the Land Use element will address all requirements set forth, under F. S . 163 and items identified under the Florida Administrative Code (27-F) . The proposed growth management document will encompass four (4) elements consisting of : a) Transportation b) Land use c) Public Facilities/Capital Improvements Program d) -Natural Systems (Revisions to the Coastal Zone Protection & Conservation Element Each element will include : -Goals , objectives and policies relevant to that element -The plan itself (Narrative and Graphics) -Standards , Guidelines and Strategies for implementation and administration of goals , objectives and policies identified • in each element . All work items to be undertaken will meet the requirements of Florida Statute 163 referencing Comprehensive Plan requirements . Additionally , all plan documents shall be required to address those portions of the Florida Administrative Code , particularly 27-F, that relate to the elements being prepared under this_ program. Documents being developed through this work program will not result in revisions of all required Comprehensive Plan elements under Chapter 163 provisions . Certain elements including Intergovernmental Coordination, Economic , : Recreation & Open Space and Housing will be revised during the second year while the County is under the Implementation and Monitoring phase of this program. It is anticipated that most of the date acquisition and analysis work for these elements will be completed under this work program. The plan elements to -be developed under this work program consist of : Transportation Element : This element will meet the statutory . provisions of Chapter 163 particularly those pertaining to traffic and circulation plan requirements . SPecifically , the document will assess the traffic related impacts of the growth management plan including specific identification of potential problem areas as well as alternatives (including cost) for mitigating these impacts ., A set of transportation management and planning guidelines will be developed that are compatible with land use growth . Energy impacts of the transportation system will be briefly reviewed and addressed in this document . Land Use Element and Map : This element will consist of development strategies and development framework for land use growth in the County . A_ Land Use Plan Map shall be developed which will be a general graphic representation of the Land Use element . The economic impacts of growth will be discussed in general terms in this element as will mechanisms for offsetting these costs . At a minimum the Land Use element will address all requirements set forth under F . S . 163 and items identified under the Florida Administrative Code (27-F) . Public Services Element : This ' document will include analyses of the following facilities and services : a . Potable Water b . Sanitary Sewer . c . Solid Waste d . Drainage e . Utilities • (15) 1) An assessment of the Comprehensive Plans and Critical Area Regulations , with Recommendations , 2-82 . 2) An assessment of Local Governments Implementation of Land Use Regulations , 6-82 . 3) Analysis of Land Development Regulations : Summary , 1-82 . 4) Florida Keys Area of Critical State Concern: Local Imple- ' mentation Issues and Recommendations , 4-82 . 5) Florida Keys Critical Area Designation Impact Analysis , 8-82 . 6) Florida Keys Critical Area Impact Analysis , Appendix B Policy Evaluation . • Each of the above will provide significant insight into the adequacy or inadequacy of existing ordinances as well as key issues needing resolu- tion . County Contribution The County will provide all copies of the Monroe County Code or Ordinances applicable to development activity in the County . All in- house assessments of development regulations as well as proposed revi- sions will be provided . Staff assistance in the review and revision of these ordinances will be provided . State Contribution • The State will provide all assessments and analyses relating to development regulations applying to the Florida Keys Area of Critical State Concern . Staff familiar with the Florida Keys critical area should be made available for input into proposed revisions . • • IV . 0 Recommend and Develop Additional land and development Control Mechanisms where applicable . General Approach The County will initiate action to develop , review and adopt new • legislative controls where these controls are found to be needed . Topic areas requiring the development of new ordinances will be derived from previous tasks under this program as well as areas of ordinance deficiency identified under Task IV B of this work program. County Contribution • The County will assist in the identification of specific areas of ordinance deficiency as well as in the development of new controls . • State Contribution Same as the County ' s contribution . It is anticipated that a minimum of one hearing in the Upper , Middle and Lower Keys will be conducted . Additional hearings may be necessary. State Contribution Upon completion of the public hearing process the State of Florida should be prepared to provide conditional approval of the plan itself and to initiate the development of a performance monitoring system by which to gauge the County ' s implementation stage . The conditional approval will be for the plan documents developed under this program only and will not cover elements of the plan to be developed in a second year . Task V Monitoring Phase Begins with DCA Coordination This is the most critical phase of the growth management plan. During this phase DCA will evaluate the ability of Monroe County to implement its plan and map . The County ' s ability to satisfactorily perform this task will be the basis for its removal from the ACSC • designation . The purpose of Task V is to develop the DCA reporting and monitoring system and define the role of Monroe County in this operation. V .A. (18) Subtasks 5 . 1 DCA certifies successful completion of monitoring phase . 5 . 2 -.DCA cert-.ifies growth management plan compliance with Chapter 380 and/or applicable statutes . 5 . 3 During monitoring period, Monroe County develops remaining elements of comprehensive plan. 5-:'31 "Public hearing process to adopt elements by County Commissioners 5 . 32. -DCA acknowledges Monroe County has met requirements of the Local Government Comprehensive Planning Act . General Approach The Department of Community Affairs. (DCA) will monitor the County ' s progress inimplementing its newly adopted growth management plan. To do this , both the plan and land use ordinances will be monitored so that compliance with growth guidelines can be evaluated . On a quarterly basis , DCA will advise Monroe County of its findings and. specific recommendations will be made to, correct deficiencies , if any . The County will agree to respond - in. writing to these findings and explain what remedial actions have..been taken. Failure to ;comply with this work task will jeopardize the. date for the County ' s removal from the ACSC designation. The DCA will use the following to judge compliance with the plan elements and local land use controls : (1) Rezoning ` petitions (2) Final actions of the Board of Adjustment (3) Final actions of the . Zoning. Board (4) ;Actions of the County Commissioners on appeals from secondary boards (5) Final actionsof the Code Enforcement Board (6) Applications/decisions -on _land clearing and dredge and fill applications (7) Major development applications: and final orders (8) Text changes . to County. land. use ordinances An important task that is not specifically related to the monitoring effort is the development and certification of the remaining elements of the comprehensive plan required by Chapter 163 F. S . Based on the work program detailed here , the. growth management plan will consist of the : following' comprehensive 'plan -elements : - (1-). Transportation (2) Land Use (3) Pub,lic facilities/C . I .P . (4): Natural system (revisions to Coastal Zone Protection and Conservation) It will be during the monitoring phase when the above elements have been properly adopted that the remaining elements of the comprehensive plan are developed 'and adopted. Specifically, these include: (1) Housing (2),- Recreation• and Open Space - (3) Economic (4') . Intergovernmental coordination (5) - 'Utility element - (6) Post-disaster planning After these elements have been reviewed andcertified by the DCA, the County will be notified that it has met the requirements of the Local Government-. Comprehensive Planning Act . ' The final action of the DCA, assuming that the County has established a favorable track record, will be its announcement that Monroe, County has successfully completed and implemented its growth management and comprehensive -plans and that it will be removed from the Area of Critical State Concern designation.
