RESOLUTION REVERSING THE DECISION OF THE
BOARD OF ADJUSTMENT OF MONROE COUNTY,
FLORIDA, WITHOUT PREJUDICE AND APPROVING THE
REQUEST OF MARATHONLIQUOR SALES , INC . TO
REVERSE THE DECISION OF THE BOARD OF
ADJUSTMENT OF MONROE COUNTY, FLORIDA, DENYING
A DIMENSIONAL VARIANCE,
WHEREAS , the Board of Adjustment of Monroe County, Florida,
on April 6 , 1983 , denied a dimensional variance= as described
below:
Of 6 feet 6 inches to build up_ t.o .18 feet . 6
inches of the North property line, and' a
variance of 16 feet 9 inches , to build up to
8 feet 3 inches of the West property line on
Lots 163 to 168 of Little Venice #2 , as
recorded in Plat Book 3 , Page 26 , and located
in Section 6 , Township 66 South, Range. 33
East . Key Vaca. M.M. 53 . Zoned BU-2 with a
BU-2C .
WHEREAS , Marathon Liquor Sales , Inc . have duly appealed said -N
decision to the Board of County Commissioners of Monroe County.,
Florida, sitting as the Board of Appeals,, and the Board having
reviewed the transcript of the April 6, 1983 hearing, having
considered the argument of all parties present wishing to speak
on the matter, and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, siting as the BOARD OF. APPEALS , as
follows :
1 . That the decision of the Board: of Adjustment of Monroe
County, Florida, on April 6 , 1983 , denying a d-imensional-".variance
as requested by Marathon Liquor Sales , Inc. be, and the same is
hereby reversed as it pertain to the side setbacks only.
2 . That the said Marathon Liquor Sales , Inc. be, and they
are hereby granted a reversal of the decision of the Board of
Adjustment of Monroe County, Florida, denying a dimensional -
variance on the above described property, as it pertains to the
-
side setbacks only.
