RESOLUTION NO. 303 -1983
RESOLUTION REVERSING THE DECISION OF THE
ZONING BOARD OF MONROE COUNTY, FLORIDA,
WITHOUT PREJUDICE AND APPROVING THE REQUEST
OF SOUTHEASTERN PROPANE CORPORATION TO
REVERSE THE DECISION OF THE ZONING BOARD OF
MONROE COUNTY, FLORIDA DENYING A CHANGE OF
ZONING FROM GU TO BU-3Y
WHEREAS, the Zoning Board of Monroe County, Florida, on
October 28, 1982, denied a change of zoning from GU to BU-3Y on
the following described property:
The west 245 feet of that part of the southwest
one-quarter of the southeast one-quarter of the
southeast one-quarter of Section 13, Township 63 South,
Range 37 East, lying northerly of the U.S. Highway #1,
LESS the north 530 feet thereof.
".
WHEREAS, Southeastern Propane Corporation has duly appealed
said decision to the Board of County Commissioners of Monroe
County, Florida, sitting as the Board of Appeals, and the Board
having reviewed the transcript of the October 28, 1982 hearing,
having considered the argument of all parties present wishing to
speak on the matter, and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
l. That the decision of the Zoning Board of Monroe County,
Florida, on October 28, 1982, denying a change of zoning from GU
to BU-3Y as requested by Southeastern Propane Corporation be, and
the same is hereby reversed.
2. That the said Southeastern Propane Corporation be, and
they are hereby granted a reversal of the decision of the Zoning
Board of Monroe County, Florida, denying a change of zoning from
GU to BU-3Y on the above described property, providing that
Southeastern Propane Corporation furnish the County with a survey
which would show a minimum of one (1) acre on the front portion
of the property which would be zoned BU-2Q with the remaining
back portion of the property zoned BU-3Y, and the rear property
line of the front portion being parrallel with the front property
line, along with evidence of Unity of Title.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 10th day of November
