RESOLUTION NO. 181 -1983
RESOLUTION AUTHORIZING THE CHAIRMAN OF THE BOARD OF
COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, TO
EXECUTE AN AGREEMENT BY AND BETWEEN THE BOARD OF
COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, AND
THE BIG PINE KEY ATHLETIC ASSOCIATION, INC.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, as follows:
That the Mayor and Chairman of the Board of County Commissioners
of Monroe County, Florida, is hereby authorized to execute an Agree-
ment by and between the Board of County Commissioners of Monroe
County, Florida, and the Big Pine Key Athletic Association, Inc.,
a copy of same being attached hereto.
Passed and adopted by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held on
the 10th day of June, A.D. 1983.

AGREEMENT
This Agreement entered into this I~ day of ~, 1983,
by and between the BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, hereinafter referred to as "County", and the BIG PINE KEY
ATHLETIC ASSOCIATION, INC., a Florida corporation, whose mailing
address is Post Office Box 89, Big Pine Key, Florida 33043, herein-
after referred to as "Association",
WHEREAS, the County and the Association entered into an agree-
ment on the 18th day of September, 1979, in which the Association
is to provide recreational/playground area on Big Pine Key for the
residents of Monroe County,
WITNESSETH, that the County and the Association for the consid-
eration hereinafter named agree as follows:
1. That the Association shall be allowed to charge a mainten-
ance fee for adult teams and other events.
2. The maintenance fee will pay for the following: field,
baseball diamond, dugout, grounds, garbage, electricity, field
lights, bathrooms, bleachers and fences.
3. The sum total of all events, both child, adult and com-
munity, will be divided into maintenance costs for the field (as
described above) in order to reach a user fee as per each scheduled
even t .
4. The use of the concession stand is to be granted solely in
the discretion of the Association and will be at all time under the
sole control of the Association.
5. The Association will structure the fee so as to be fair and
equitable to all teams and groups using the field.
.' 6. The Association will have exclusive control of scheduling
events and will have the sole right to refuse entrance to anyone or
any organization, except where the same is granted by the County
Commission.
(a) Cause for exclusion may be the deliberate destruction of
the field or concession building, alcoholic beverages on the grounds,
and indecent or immoral behavior such as obscenities, fighting, ex-
treme violence or threat of harm.
7. The terms of this agreement shall run concurrent with the
term of that certain lease dated March 25, 1980, between the Big Pine
Key Athletic Association, Inc. and the County of Monroe, State of
Florida, expiring on March 24, 1990.
