Resolution 207-1983 RE$(t)CU't!(t)N N(t). 207 -1982 WHEREA.$, the B(t)ARD (t)f C~UN'tM C~mm!$$!~NER$ ~f m(t)NR~E C(t)UN'tM, fC~R!DA, has receiveD an application from JACK D!CK.SS~N anD IDHEREA.$, in compliance with $tate $tatute, it is necessary as part of the permitting proceDure to reaD the following Biological Assessment into the RecorD, as follows: The applicant proposes to control erosion and provide improved boat mooring facilities. Both goals will be achieved through the construction of a 35 ft. long vertical concrete seawall with a 4 ft. wide cantilevered concrete dock along its length. The seawall will be located approximately 4 ft. waterward of the old shore- line. An estimated 35 cu. yds. of backfill with 25 cu. yds. waterward of mean high water (MHW) and 10 cu. yds. landward of MHW will be required. An estimated 210 sq. ft (0.005 ac.) of marine habitat will be eliminated by the seawall and an additional 140 sq. ft. covered by the dock. Riprap will be placed at the toe of the seawall. The seawall and dock will be poured in place. All supplies will be brought to the site over upland routes. No description of proposed techniques for maintaining water quality during construction were provided with the application. The project site is in the Outdoor Resorts at Long Key recreational vehicle park. The park is located on the north side of the west end of Long Key, Monroe County. Within the 30~ acre park, a system of two main trunk canals with three each finger canals provide water front access to many of the 400~ trailer lots. The park is a condominium with 95+ percent of the available sites presently occupied by recreational vehicles. Many of the vehicles are apparently permanently located. The Florida Bay shoreline of the park was created by filling out into the bay. A boulder riprap revetment orginally protected the entire shoreline. Much of the revetment has been replaced over the years by a series of seawalls. Many of the seawalls apparently have been constructed without proper authorization. Long Key State Recreation area is located approximately 400 ft. to the east of Outdoor Resort. The waters of the recreation area are designated as Class III, Outstanding Florida Waters (Chapters 17-3.041 and 17-3.081, Florida Administrative Code). The project site is located near the northeast corner of the park on a shoreline which faces Florida Bay. Adjoining the west side of the site is a vacant lot which retains its original riprap shoreline. The lot which borders the east side of the site is occupied by a trailer and has a seawall and dock of a design virtually identical to that being requested here. Permit No. 440565055, issued to Lonn Stone on December 16, 1982, authorized this adjacent seawall/dock. An unnamed road runs along the north side of the project site. Florida Bay in the vicinity of the project site is designated as Class III Waters (Chapter 17-3.081 and 17-3.161, Florida Administrative Code). The applicant's property is an 80~ ft. by 35~ ft. (0.064 ac.) trailer lot. One of the 35 ft. sides borders on Florida Bay. Virtually all of the site consists of uplands. A mobile home and paved areas cover most of the lot. Resolution Jack Dickson Page Two The site shoreline consists of a large boulder riprap revetment. The toe of the revetment extends out to a depth of approximately 1 ft. mean low water (MLW) and the top is at an elevation of approximately 3 ft. MHW. The upper reaches of the revetment are inhabited by beaded periwinkles (Tectarius muricatus), zebra periwinkles (Littorina ziczac), and tessellate nerite (Nerita tessellata). Biota found on the lower levels of the boulders includes channeled turban hermit crabs, sea urchins, sargeant majors (Abudefduf sacitilis), Laurencia sp., Hypnea sp., Ectocarpus sp., Padina sp. and Halimeda sp. Beyond the toe of the revetment, the seafloor drops at a moderate rate. The seafloor near the revetment consists of calcareous sediments. The revetment appears to be fundamentally intact and properly functioning to protect the applicant's shoreline. The proposed seawall will be located two or three feet waterward of the toe of the revetment. Construction related activities can be expected to cause increased levels of dissolved organic compounds, particulate organic compounds and turbidity in the nearby waters. Proper use of turbidity control techniques should be able to control these impacts within acceptable levels. The applicant has, however, not indicated any plans to utilize turbidity control measures. The proposed seawall and dock will eliminate the present shoreline biota. Once the riprap is placed at the toe a new biological community should be able to establish itself. As a result of shading, it is believed that the floral components of the community will generally be less abundant and more shade tolerant than the preconstruct ion flora. Under the provisions of Chapters 253 and 403, Florida Statutes and Chapter 17-3 and 17-4, Florida Administrative Code, I recommend that Departmental permitting authorization be granted to the application with the following condition: The riprap placed at the toe of the seawall shall consist of limestone boulders with diameters of not less than 18 inches. Virtually all ofthe site consists of uplands . /A mobile home and paved areas cover most of the lot. The site shoreline consists of a large boulder riprap revetment. The toe of the revetment extends out to a depth of approximately 1 ft. mean low water (MLW) and the top is at an elevation of -- approximately 3 ft. MHW. The upper reaches of"the revetment are inhabited by beaded periwinkles (Tectarius muricatus) , zebra periwinkles (Littorina ziczac) , and tessellate nerite (Nerita tessellata) . Biota found on the lower levels of the boulders includes channeled turban hermit crabs , sea urchins , sargeant majors (Abudefduf saxitilis) , Laurencia sp. , Hypnea sp. , Ectocarpus sp. , Padina sp. and Halimeda sp. Beyond the toe of the revetment, the seafloor drops at a moderate rate. The seafloor near the revetment Consists of calcarious sediments . - +. The revetment appears to be fundamentally intact and properly functioning to protect the applicant' s shoreline. The proposed seawall will be located two or three feet waterward of the toe of the revetment. D. Construction related activities can be expected to cause increased levels of dissolved organic compounds, particulate organic compounds and turbidity in the nearby waters . Proper use of turbidity control techniques should be able to control these impacts within acceptable levels. The applicant has, however, not indicated any plans to utilize turbidity control measures . • The proposed seawall and dock will eliminate the present shoreline biota. Once the riprap is placed at the toe a new biological community should be able to establish itself.
