Resolution 084-1983 RESOLUTION NO. 084 -1983 RESOLUTION AMENDING RESOLUTION NO. 293-1982 ADOPTED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA ON NOVEMBER 16, 1982, AUTHORIZING THE EXECUTION OF A SIGN LEASE AT THE MARATHON AIR- PORT BY AND BETWEEN NOR-I1AR JOINT VENTURE D/B/A KEY COLONY POINT AND THE COUNTY OF MONROE, STATE OF FLORIDA. WHEREAS, the Board of County Commissioners of Monroe County, Florida, previously adopted Resolution No. 293-1982 on November 16, 1982, authorizing the execution of a Sign Lease at the Marathon Airport by and between Nor-Mar Joint Venture d/b/a Key Colony Point and the County of Monroe, State of Florida, and WHEREAS, it has been brought to the attention of said Board that said Sign Lease has been executed by First Federal Savings and Loan Association of the Florida Keys d/b/a Key Colony Point instead of Nor-Mar Joint Venture d/b/a Key Colony Point, and WHEREAS, it is now necessary to amend said Resolution No. 293- 1982 to reflect the change of name of Lessee, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: 1. That said Board hereby amends Resolution No. 293-1982 which was adopted by the Board of County Commissioners of Monroe County, Florida, on November 16, 1982, authorizing the execution of a Sign Lease at the Marathon Airport by and between Nor-Mar Joint Venture d/b/a Key Colony Point and the County of Monroe, State of Florida, to reflect the change of name of Lessee to First Federal Savings and Loan Association of the Florida Keys d/b/a Key Colony Point. 2. That in all other respects, said Resolution No. 293-1982 shall remain in full force and effect. Passed and adopted by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 31st day of March, A.D. 1983. I .-. -.., SIGN LEASE THIS LEASE made and entered into on the 16th day of November , 1982, by and between the COUNTY OF MONROE, @ STATE OF vLORIDA, a political subdivision of the State of Florida, FIRST FEDERAL SAVINGS & LOAN ASSOCIATIOI\ as Lessor, and ' ~ ~ Driv~ principal office is located at hereinafter referred to OF TIIE F1.ORIDA KEYS d/b/a KEY COLONY POINT, whose Ke West Florida, 33040 , hereinafter referred to as Lessee. IN CONSIDERATION of the mutual covenants, promises and premises herein contained, the parties hereto agree as follows: Section 1. Description of Premises and Use. Lessor hereby leases to Lessee and Lessee hires from Lessor for the pur- pose of installing one (1) sign as hereinafter described at the Marathon Airport, Marathon, Monroe County, Florida owned and operated by the COUNTY OF MONROE in a location to be approved by the Airport Supervisor of the Marathon Airport. Section 2. Term of Lease. This lease shall begin on the 1st day of October, 1982 and shall end on the 31st day of December, 1982. Lessee shall have the option of renewing said lease for an additional three (3) months upop written notice to Lessor no later than November 30, 1982. Section 3. Rent. The Lessee shall pay to the Lessor the total rent for the term of this lease One Hundred Eighty Dollars ($180.00), in lawful money of the United States of America - plus any sales tax ~n advance upon execution of this lease or any renewal hereof. If Lessee terminates .this lease prior to the end of the term hereof, Lessee shall not receive any refund. Section 4. Sign. The Lessee is her~by granted the right to install one (1) sign, three feet high by three feet wide, (31 X 3'), in the area stated in Section 1. The Lessee shall submit to the Lessor a detailed drawing of the sign setting forth all wording to be placed on the sign including material to be used in the construction thereof, colors, and any other matter relating , ~. ~ .. f -2 - thereto for approval by the Lessor prior to installation of same. The sign shall be constructed in a professional manner and in- stalled at the location designated herein in accordance with the instructions of Lessor. Section 5. Maintenance. The Lessee shall maintain the sign in good order at all times during the term of this lease and if Lessee fails to do so, Lessor shall give Lessee ten (10) days notice of this failure to comply and upon Lessee's failure to comply in maintaining said sign, Lessee does hereby give, grant, and authorize the Lessor to remove said sign at Lessee's expense. Waste and Nuisance Prohibited. Lessee Section 6. shall not commit or suffer to be committed any waste in the demised premises or any nuisance. Section 7. Taxes. Lessee shall pay, before delinquent, all personal property taxes assessed against said signs. Section 8. Termination and Repairs. Lessee shall at the termination of this lease remove any sign installed hereunder immediately upon termiantion and shall repair any damage caused by sid removal. If Lessee does hereby give, grant, and authorize the Lessor the right to remove said sign in behalf of Les~ee at Lessee's expense.
