RESOLUTION AUTHORIZING THE CHAIRMAN OF THE BOARD OF
COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, TO
EXECUTE AN AGREEMENT BY AND BETWEEN FRANK KEEVAN &
SONS, INC. AND THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, FOR THE PURPOSE OF RE-
PAIRING DAYBEACONS UNDER THE BOATING IMPROVEMENT
FUND PROJECT AT KEMP CHANNEL, MONROE COUNTY, FLORIDA.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, as follows :
That the Mayor and Chairman of the Board of County Commis-
sioners of Monroe County, Florida; is hereby authorized to execute
an Agreement by and between Frank' Keevan & Sons, Inc. and the
Board of County Commissioners of Monroe County, Florida, a copy of
same being attached hereto, for the purpose of repairing daybea-
cons under the Boating Improvement Fund Project at Kemp Channel,
Monroe County, Florida.
Passed and adopted by the Board of County Commissioners of
Monroe County, Florida, , at a regular meeting of said Board held on
the 29th day of April, A.D. 1983 .

AGREEMENT
THIS AGREEMENT made this 29th -. day of April
1983 by and between FRANK KEEVAN & SONS, INC. , Contractors, hereinafter called
the "Contractor", and the BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, of the County of Monroe, State of Florida, hereinafter called the
"Owner" ,
WITNESSETH, that the Contractor and the Owner for the consideration
hereinafter named agree as follows :
1 . The Contractor shall furnish all the materials and perform all the.
work as required by the Specifications for Boating Improvement Fund Project
at Kemp Channel - Daybeacon Installation': and Repair, Monroe County, Florida,
a copy of which is attached hereto and made a part hereof.
2. The work to be performed under the contract shall be commenced within
thirty (30) days from date Owner provides Notice to Proceed and be completed
within one hundred and twenty (120) days' of the commencement or it shall be
commenced in accordance with clause No. 4.
3. Further, the parties agree that if the Notice toProceed has not
been given by Owner to Contractor on or before September 15, 1983 or the
work has not been undertaken according to Clause No. 4, Agreement shall be
null and void.
4. It is understood that the Contractor is presently mobilized to
do the work and is willing. to perform the work defined herein , at his own
risk and without monetary compensation. It is further agreed that payment
for the work will not be forthcoming from the Owner to the Contractor unless
the project grant application is approved by the Department of Natural
Resources, Boating Improvement Fund. If State Department of Natural Resources
approval of funding does not occur, then the Contractor agrees_ that the work
performed will be regarded as a donation and no monies will be transferred
between the parties.
