RESOLUTION UPHOLDING THE DECISION OF THE BOARD
OF ADJUSTMENT OF MONROE COUNTY, FLORIDA, AND
DENYING THE REQUEST OF DON PETERSON TO REVERSE
THE DECISION OF THE BOARD OF ADJUSTMENT DENYING
WAIVER OF SECTION 19- 217 (h) OF THE MONROE COUNTY
CODE OF ORDINANCES .
WHEREAS , the Board of Adjustment of Monroe County, Florida,
denied the request of Don Peterson for waiver of Section 19- 217 (h)
of the Monroe County Code of Ordinances as described below:
The denied waiver of Section 19- 217 (h) of the
Monroe County Code of Ordinances , which states
that "no business shall be conducted in any
BU- 2 zoning district unless and/or until there
is a building on the property at least one
hundred fifty (150) square feet in size with
at least one (1) toilet and one (1) lavatory
connected to a sewage disposal system approved
by the County Health Department or the Dept .
of Environmental Regulations" , on property
described as Lots 31 , 32 &33 , Block 1 , Cudjoe
Ocean Shores Subdivision, as recorded in Plat
Book 5 , Page 107 and located in Section 28 ,
Township 66 South, Ronge 28 East , Cudjoe Key,
Zoned BU- 2 . (Use - Private Boat Storage -
. Venture Out)
WHEREAS , Don Peterson having duly appealed said decision to
the Board of County Commissioners of Monroe County, Florida, sitting
as the Board of Appeals , and the Board having reviewed the transcript
of the March 18 , 1983 hearing , having considered the argument of all
parties present wishing to speak on the matter , and all premises
considered, now, therefore ,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, sitting as the BOARD OF APPEALS , as follows :
1 . That the decision of the Board of Adjustment of Monroe
County, Florida, of March 18 , 1983 , denying waiver of Section 19-217 (h)
of the Monroe County Code of Ordinances for the above described
property, for Don Peterson be, and the same is hereby upheld.
2 . That the said Don Peterson be and he is hereby denied a
reversal of the decision of the Board of Adjustment of Monroe County,
Florida denying waiver of Section 19-217 (h) of the Monroe County
Code of Ordinances .
