RESOLUTION NO. 020 -1983
A RESOLUTION AUTHORIZING MODIFICATION OF THE
ACTION TAKEN BY THE COUNTY COMMISSION ON
AUGUST 24, 1982 , CONCERNING THAT PROPERTY
DESCRIBED AS LOTS 1 THROUGH 20 , INCLUSIVE OF
BLOCK 24 OF MALONEY SUBDIVISION, AS RECORDED
IN PLAT BOOK 1, PAGE 55 , ALSO DESCRIBED AS
ALL OF BLOCK 24 OF MALONEY SUBDIVISION, STOCK
ISLAND , MONROE COUNTY, FLORIDA.
WHEREAS , the County Commission did on August 24, 1982 , reverse
the decision of the Board of Adjustment concerning facts on the
property described as Lots 1 through 20 , inclusive of Block 24 of
Maloney Subdivision, as recorded in Plat Book 1, Page 55 , also
described as all of Block 24 of Maloney Subdivision, Stock Island,
Monroe County, Florida, which is owned by Fausto' s Food Palace, and
WHEREAS , the parties to the proceedings before the Board of
Adjustment and the County Commission have agreed in writing to a
review of the same from the standpoint of making a partial change
therein, and
WHEREAS , the County Commission desires to alter the decision
made on August 24, 1982 , now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, as follows :
1. That the Petition for Rehearing heretofore filed by
Fausto' s Food Palace concerning the action of the Commission on the
24th of August, 1982 in reversing the action of the Board of Adjust-

ment be and the same is hereby altered and amended to the extent
that the thirty-five foot (35 ' ) variance to be located on the front
end of said property described as Lots 1 through 20, inclusive of
Block 24 of Maloney Subdivision, as recorded in Plat Book 1, Page
44, also described as all of Block 24 of Maloney Subdivision, Stock
Island, Monroe County, Florida , as requested formerly be and the
same is hereby granted.
2. That the granting of the same is predicated on the agree-
ment of the parties , to-wit : Fausto' s Food Palace, Inc. , the

movant herein, and the objector to the same, Joseph Garrido, it being
reflected in writing that the aforesaid Joseph Garrido has agreed
with this action and offers no objection thereto.
Passed and adopted by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held on
the 7th day of January, A.D. 1983 .
