RESOLUTION NO.T030 -1983
RESOLUTION APPROVING MEMO OF UNDERSTANDING BY AND
BETWEEN THE MONROE COUNTY MUNICIPAL SERVICES DIS-
TRICT AND THE MONROE COUNTY TRANSLATOR BOARD.
WHEREAS, the Monroe County Translator Board desires to enter
into a Memo of Understanding with the Monroe County Municipal
Services District for the leasing of lands in North Key Largo for
the purpose of constructing a Television Translator Tower, and
WHEREAS, said Memo of Understanding has met with the approval
of both the Translator Board and the governing body of the Municipal
Services District, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, acting as the governing body of the Translator
Special Tax District, that said agreement between the Translator
Board and the Monroe County Municipal Services District, be and
the same is hereby approved.
BE IT FURTHER RESOLVED BY SAID BOARD that funds for the payment
of any bills incurred through the aforesaid memo be paid from monies
derived from the one-quarter mill provided for in Ordinance No. 5-
1982.
Passed and adopted by the Board of County Commissioners of
Monroe County, Florida, acting as the governing body of the Translator
Special Tax District, at a regular meeting of said Board held on the
21st day of January, A.D. 1983.

AGREEMENT
Between
Monroe County Board of County Commissioners as the governing
body of the Monroe County Municipal Services District and Charles
P. Aguero, Municipal Services Manager, hereinafter referred to
collectively as MSD
and
Monroe County Board of County Commissioners as the governing body
of the Monroe County Special Taxing District for the Translator
System and Frank Shortman, Chairman of the Monroe County Television
Translator Board, hereinafter referred to collectively as the
Translator Board.
WHEREAS, MSD owns a tract of land of approximately IS
acres which is located in North Key Largo, more particularly
described as:
Part of the Southeast 1/4 of the Northwest 1/4,
Section 10, Township 60 South, Range 40 East,
Key Largo, Monroe County, Florida as recorded in
the Official Records Book pages 98-99, Official
Records of Monroe County and being more particu-
larly described in Official Records Book D4, page
433 of the Public Records of said Monroe County,
Florida,
which land is necessary, useful and profitable In the operation
of the MSD facilities, and
WHEREAS, the Translator Board requires the use of approxl-
mately two (2) acres for the purpose of erecting a Television
Translator Tower, and
WHEREAS, MSD has agreed to lease to the Translator Board
the approximately two (2) acres required by the Translator Board
for a term of two (2) years upon the condition that prior to or
upon expiration of that two (2) year term, the Translator Board
will transfer to MSD another parcel of land of approximately two
(2) acres, said land to be contiguous to MSD's IS acre parcel, in
exchange for title passing to the Translator Board for the two (2)
acre tract that is the subject of this agreement, now therefore
MSD and the Translator Board mutually agree as follows:
1. The approximately two (2) acre tract required by
the Translator Board is necessary, useful and profitable in the

operation of the MSD facilities.
2. MSD will lease to the Translator Board the approxi-
mately two (2) acres required by the Translator Board for a term
of two (2) years, the exact description of said land to be
determined by a survey.

3. Consideration for the lease will be In the amount
of One Dollar ($1.00) per year to be paid by the Translator Board
to MSD.
4. Prior to or upon the expiration of the two (2) year
lease the Translator Board agrees to transfer to MSD another two
acre parcel which is to be contiguous to MSD's 15 acre parcel
located in North Key Largo.
5. Upon the transfer of the additional two (2) acres
to MSD, MSD will transfer title of the two acres that are the
subiect of this lease to the Translator Board.
6. During the term of the lease, the Translator Board
grants to MSD the right to drive and park vehicles across the
leased two (2) acre tract and to otherwise have access to the
site so long as the driving of vehicles and other access do not
interfere with the construction or ongoing operation of the
translator tower.
Agreed between the parties this ~ day of January, 1983.
