RESOLUTION NO. 323-1981
RESOLUTION AUTHORIZING THE CHAIRMAN OF THE BOARD
OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA,
TO EXECUTE AN AGREEMENT BY AND BETWEEN MONROE
COUNTY, FLORIDA AND CUNNINGHAM, ALBRITTON & LENZI,
P.A.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MON-
ROE COUNTY, FLORIDA, as follows:
That the Chairman of the Board of County Commissioners of
Monroe County, Florida, 1S hereby authorized to execute an agree-
ment by and between Monroe County, Florida and Cunningham, Al-
britton & Lenzi, P.A., a copy of same being attached hereto.
Passed and adopted by the Board of County Commissioners of
Monroe County, Florida at a regular meeting held on the 3rd day
of November, A.D. 1981.

AGREEMENT
AGREEMENT made this :3Td day of November , 1981, by
and between Monroe County, Florida ("County") and Cunningham,
Albritton & Lenzi, P.A, ("Cunningham").
WHEREAS, the County maintains the official records books
and indexes thereof at the Monroe County Courthouse at Key West,
Florida; and
WHEREAS, copIes of such official records books are maintained
on microfilm; and
WHEREAS, said books subject to destruction in the event of a
catastrophe, natural or otherwise; and
WHEREAS, it is in the best interest of the County to maintain
copies of such official records books at different locations
whereby such books are regularly inspected and maintained in the
event it is necessary to replace records kept at the Monroe County
Courthouse; now, therefore,
In consideration of the premises and of the mutual covenants
contained herein, the parties agree as follows:
1. County shall prepare and deliver to Cunningham one set
of microfilm copies of all Official Records Books (Numbers 1-839),
together with microfilm indexes.
2. Cunningham shall pay to County the cost of preparation
of such copies in the amount of $3,000.
3. Cunningham shall maintain such records In a safe place
and shall repair or replace any films damaged or destroyed at its
own expense.
4. Upon request of the County, Cunningham shall make the
records available for the purpose of making copies at no expense
to County. All costs of reproduction and copying shall be borne
by County. Cunningham shall not be entitled to receive the fee~
and charges provided by Chapter 703, Florida Statutes.
