Resolution 325-1981RESOLUTION NO. -195 -1981 WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, has received an application from G. Brock Hook & Marilyn J. Hook and, WHEREAS, in compliance with State Statute, it is necessary as part of the permitting procedure to read the following Biological Assessment into the Record, as follows: This is an after -the -fact application for the repair and expansion of a pre- viously existing riprap groin and boat ramp, the filling and stabilizing of a wetland shoreline and the construction of a cantilevered dock to extend from said repaired groin. In all, 150 cubic yards of limerock fill, riprap and cement was used to re- pair and rebuild the old riprap groin. Though the applicant claims that this entire amount was placed above MHW, a small amount of material - primarily riprap and cement slurry - went in below MHW. By filling the existing groin with limerock fill (after riprapping and cementing the groin sides) the ele- vation and mergent width (Above MHW) of the groin was raised and widened, re- spectively. To cement, solidify and generally even out the groin in this manner, it was necessary to insert and cement some of the riprap at the groin base, below MHW. All of the materials used for groin repair were brought to the site by truck over existing roads. Approximately 35 cubic yards of concrete will be used in the construction of the contilevered cement dock and its underlying beams. In all, 28 of these cement beams have been anchored to the groin. These beams will support a four foot wide dock, which will extend approximately three feet out over an artificial waterway. The purpose of this activity is to provide guest mooring at a motel located on the applicant's property. In addition, the applicant has enlarged a previously existing boat ramp (pre- vious waterward extent unknown) by pouring cement over the original surface and possibly waterward (present boat ramp now extends 10-15 feet below MHW). There was also some fill and cement placed on wetlands at the base of and to the east of the riprap groin. This was apparently done to remove the low dis- continuous shoreline that existed prior to filling (lot 4 shoreline to the east had been previously bulkheaded waterward of the applicant's shoreline). The applicant's property is situated on Vaca Cut, to the north of U.S. #1, on the east side of the cut. Vaca Cut is a narrow channel separating Vaca Key and Fat Deer Key. It also connects Florida Bay with the Atlantic and because os its narrow width, has extremely strong tidal currents. The shallower shoreline shelves of this channel. including adjacent flats on the bay and ocean sides, display luxuriant seagrass (Thalassic testudinum) beds. The deeper, more heavily scoured channel bottoms support a variety of sessile organisms, primary of which are encrusting sponges and gorgonias. To the north of U.S. # 1, on the western shoreline of Vaca Cut, the shoreline community is made up entirely of red mangroves (Rhizophora mangle). The eastern shoreline, however, displays residential and motel units with associated riprap revetments, seawalls, basins, docks, and a deadend canal This deadend canal borders the applicant's property to the west, connecting Vaca Cut to the applicant's motel (Royal Hawaiian Motel). This canal is 60 feet wide and at least 10-15 feet deep. The inland or southern part of this canal has been vertically bulkheaded. The waterward of northern canal shore- line have been riprapped with some grouting done for stabilization. Because of the box cut nature of this canal, the canal walls here are steeply sloped. To the east of the applicant's property (toward Florida Bay) waterfront housing begins (starting with lot 4 adjacent of applicant's property). The shoreline bordering this housing meanders inland from Vaca Cut forming what is referred to as Pearl Harbor. Resolution G. Brock Hook & Marilyn J. Hook Seawall Page Two The undeveloped shoreline of Pearl Harbor is primarily exposed Key Largo limestone, extending landward until sufficient topsoil permits vegetative growth and waterward out to the line of MLW. Waterward of MLW, where accumulated detrital matter has not collected so as to form unconsolidated bottom sediments (detrital matter collects during winter northerly winds), the bottom displays a dense growth of turtle grass (Thalassia testudinum). The substrated in the area of these grass beds is generally plus of minus one foot of soft muds overlying caprock (Key Largo limestone). Hawaiian Village subdivision was platted in 1958. This subdivision includes lots to the east and west of the applicant's property bordering Vaca Cut. As orginally platted, the riprap groin that was. repaired by the applicant was part of a private right of way zone, owned in part by all of the landowners within Hawaiian Village. Also, as originally platted, the riprap groin extended only to its present base. The eastern land base of the riprap groin was extended to what was originally platted as the riprap groin end around 1960. The groin it- self was also extended around the same time (as can be best determined) to its present length contiguous with the western canal shoreline. The applicant, upon request, was unable to furnish any property line meets and bounds, deeds, or title transfers that would show legal claim to the extended riprap groin or the eastern groin base. The applicant does, however, have possession of quit -claim deeds from the original Hawaiian Village landowners, releasing their interest in the private right of way originally established. These quit -claim deeds were recorded in 1965. From old -.aerials, it is apparent that the extended riprap groin has undergone changes in its configuration. It has, at various times, been awash to the point of allowing regular tidal exchange from side to side. It has, at other times, been filled to within 15-20 feet of the end (this was its condition immediately before repair work was begun). Before construction was begun by the applicant, the riprap groin was a com- bination of rock and fill, approximately 10 feet wide at the top, tapering down at its rock base to approximatley 15 feet. The terminal 15-20 feet were unfilled with water exchange occurring frequently, if not daily, through the groin. The groin base provided habitat for a variety of fish, including snapper (Lutjanus sp.), grouper (E ine helus morio), sergeant majors (Abudefduf saxatilis), damselfish.(Euo macentrus sp.), grunts Haemulon sp.), parrotfish Scarus sp.), and barracuda Sphyraena barracuda). Substrate was also provided for various species of anenomes, sponges, and brown algaes (Laurencia sp.). Addi.tionally, habitat was available here for spiny lobster (Panilurus argus) and other large crustaceans such as spider crabs (Majidae). On the canal side of the groin, the macroinvertebrate population declines•rapid- ly as canal depths increase. On the shaglow bay side of the groin, turtle grass flats are encountered within 5-10 feet of the groin. Some of the species ob- served over these flats include anenomes, urchins, parrotfish and barracuda. Near the landward (southern) base of the groin extension, the bay bottom is unconsolidated, with little or no macrophyti.c growth. Above the MHW line at the base, the shoreline, because of a small discontinuity, had collected a large amount of organic detritus. Within this detritus, numerous small red and black mangroves (Rhizophora mangle and Avicennia germinans, res- pectively) had begun to grow. Continuing landward, transitional vegetation such as batis (Batis maritima) was present. This wetland area was filled by the applicant up to a line continuing from the bulkhead line of lot 4 (approximate MHW line). •Ak Resolution G. Brock Hook & Marilyn J. Hook Seawall Page Three The elimination of much of the submerged marine habitat by filling of holes and crevices previously a part of the riprap groin. The area of particular concern is the terminal 10 to 20 feet of the groin where no previous fill was placed, and which previously provided habitat for a diversity of marine species.. Additionally, the shoreline discontinuity which was filled at the base of the groin provided a detrital catch conducive to microbial, bacterial and protozoan growth. These organisms, consequently, provide a nutrientrich source of food for the higher order species such as crabs, shrimp, and smaller fishes. It is anticiapted that the proposed dock will favor the growth of more shade tolerant algaes, thereby eliminating some present species that require direct light penetration. While inhibiting species diversity to some extent, most of the present algae species here are already non-chlorophll containing, thus causing only minimal impact. Over the long term, some petroleum and domestic wastes are anticiapted as a result of increased boat usage associated with the proposed dock construction. DISCUSSION Annlicants are requesting after -the -fact approval for the following repairs made to an existing rip -rap groin. 1. Placement of 15 lineal feet of riprap (18" high x 15 " wide) between existing rip -rap to either side along the MHW line of Florida Bay. 2. Construction of 243.6 feet of cantilever seawall with the 4 foot wide concrete walkway along a man-made canal (the cantilever to extend 3 feet waterward of MHW). NOTE: According to Mr. Dumont Sterling, Assistant Building Official, 163- feet of this seawall was approved in Building Permit #, B6820 (see attached) 3. Resurface a 14 ft.wide x 22 ft. long boat ramp with concrete. Concrete was also used to cement together rip -rap boulder along the canal and Florida Bay. 4. Approximately 150 c.y. of limerock fill, rip -rap and cement was required to repair the groin (including the seawall backfill, and the amount used to raise the elevation and possibly widen the groin, according to the DER report). 5. In addition, the applicant has enlarged a previously existing boat ramp (previous wazernaard extent unknown) by pouring cement over the original surface and possibly waterward (present boat ramp now extends 10-15 feet below 21,11fflq) . There was also some fill and cement placed on wetlands at the base of and to the east of the riprap groin. This deadend cans_ bor:e-s the applicant's property to the west, connecting Vaca Cut zo the applicant's motel (Royal Hawaiian Motel). This canal is 60 feet wide and at least 10-15 feet deep. The inland or southern part of this canal h«s been vertically bulkheaded. The waterward or northern canal shorelines have been ripranped with some grouting done for stabilization. Because of the box cut nature of this canal, the canal walls here are steeply sloped. To the east of the applicant's property (towards Florida Bay) waterfront housing begins (starting with lot 4 adjacent to appli- cant's property). The shoreline bordering this housing meanders inland from, Vaca Cut forming what is referred to as Pearl Harbor. The undeveloped shoreline of Pearl Harbor is primarily exposed Key Largo limestone, extending landward until sufficient topsoil permits vegetative growth and waterward out to the line of MW. Waterward of MLW, where accumulated detrital matter has not collected so as to form unconsolidated bottom sediments (detrital matter collects durin winter northerly winds), the bottom displays a dense growth of turtle grass (Thalassia testudinum). The substrate in the area of these grass beds is generally plus or minus one foot of soft muds overlying caprock (Key Largo limestone). Hawaiian Village subdivision was platted in 1958. This subdivision includes lots to the east and west of the applicant's property, bordering Vaca Cut. As originally platted, the riprap groin that was repaired by the an_plicant was hart of a private right of way Zc , o .nee. _.. part r2r ' ' V111�ze. ? as ' _ w only to its present base. The eastern land base of the riprap groin was extended to what was originally platted as the riprap groin end around 1960. Before construction was begun by the applicant, the riprap groin was a cor:Dination of rock and fill, approximately 10 feet wide at the top, tapering down at its rock base to approximately 15 feet. The terminal 15-20 feet were unfilled with water exchange occurring frequently, if not daily, through the groin. The -groin base provided habitat- for a variety of fish, including snapper (Lutjanus sp.), grouper (Eninenhelus morio), sergeant majors (Abudefduf saxatilis), damselfish Eupomacentrus sp_), _ grunts (Haemulon sp.), parrotfish (Scarus sp.), and barracuda (Spryraena barracuda). Substrate was also provided for various species of anenomes, sponges, and broom algaes (Laurencia sp.). Additionally, habitat �-;as available here for spiny lobster (Panilurus arms) and other large crustaceans such as spider - crabs (:iaj i4ae On the canal side of the groin, the macroinvertebrate population declines rapidly as canal depths increase. On the shallow bay side of the groin, turtle brass flats are encountered within 5-10 ices of the groin. Some of the species observed over these flats include anenomes, urchins, narrotfish and barracuda. Near the landward (southern) base of the groin extension, the bay bottom is unconsolidated, with little or no macrophytic growth. It is anticipated that the proposed dock will favor the growth of more shade tolerant algaes, thereby eliminating some present species that require direct light penetration. While inhibi- Ling species diversity to some extent, most of the present algae species here are already non-chlorophll containing, thus causing only minimal impact. Over the long term, some petro- leum and domestic wastes are anticipated as a result of in- creased boat usage associated with the proposed dock construe----- tion. G.`Brock Hook, Application ITEM 6 cont. The material involved are redi-mix concrete and clean fill from an upland site. All materials are brought to the site over existing roads and the applicant's property by truck. All work takes place above MHW line. ITEM 15 continued placement of approximately 1150 c.y. of clean upland fill between the landward and waterward faces of the rip -rap walls of the groin. All work that has taken place thus far appears to be above and landward of MHW marks. The applicant wishes to complete this project as described in Item 6. Included in this after the fact permit I wish to also complete the three concrete pilings that are already installed to finish the walkway and the North end of the groin. Furthermore on the South end where the boat ramp is, the North and South sides of the ramp facings were covered with small rip -rap to beautify and hold back for additional support any fill placed above MHW. The existing ramp was resurfaced with approximately 10 cu. yards of 5000 lb. rough concrete. Any material deposited waterward of'MHW during groin repair and ramp repair is already existing and cannot exceed 4 yards of clean fill or overpour of concrete. Also, on sketch SK8-061 marked rip -rap S.L. with XXX, I wish to reinstall a small rip -rap border on the edge of MHW to facilitate any washout from upland areas into gulf. This land slopes fast to MHW edge and this border of approximately 18 inches high 15 feet long and 15 inches wide would stop any runoff in this area. This border was existing from Lot 1 to the existing rip -rap groin but through erosion was broken up into small sections and removed.
