Ordinance 006-1985Commissioner Alison Fahrer ORDINANCE NO. 006-1985 AN ORDINANCE CREATING A CAPITAL IMPROVEMENT STUDY COMMITTEE; STATING THE DUTIES AND FUNCTIONS OF SAID COMMITTEE; CREATING THE MEMBERSHIP OF SAID COMMITTEE AND SETTING FORTH THE TERMS OF THE MEMBERS THEREOF; PROVIDING FOR THE FUNCTIONS OF SAID COMMITTEE AND THE MEETING REQUIREMENTS OF THE SAME PROVIDING FOR THE LOCATION OF MEETINGS; PROVIDING FOR THE REIMBURSEMENT FOR TRAVEL EXPENSES FOR ATTENDING OFFICIAL MEETINGS IN ITS OFFICIAL FUNCTION; REQUIRING THE COUNTY ADMINISTRATOR AND DEPARTMENT HEADS TO COOPER- ATE WITH THE COMMITTEE IN ITS ACTIVITIES; PROVIDING FOR SEVERABILITY; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE TO THE EXTENT OF SAID CONFLICT; PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES OF MONROE COUNTY, FLORIDA; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. CREATION -- That a committee be created to be known as the Capital Improvement Study Committee to be composed of a membership of five (5) residents of Monroe County, the general purpose of said Committee to be to study and review the fixed capital assets of Monroe County so as to perform the functions hereinafter stated. Section 2. MEMBERSHIP -- The Capital Improvement Study Committee shall consist of five (5) members all of whom shall be residents of Monroe County. The terms of the various members of this Committee shall run concurrent with and for the same length of time as the Commissioner who made the appointment. The Capital Improvement Study Committee shall elect from its members a chairman who shall serve for one (1) year, it being provided that the election of the chairman and any other officers shall be conducted at its first meeting of each year. Minutes of all meetings shall be kept along with any pertinent records or other documents accumulated by the Committee. Section 3. FUNCTIONS -- The Capital Improvement Committee is entrusted with the review of all present fixed capital im- provements owned by Monroe County. It shall review the same from the standpoint of improving and/or repairing said capital im- provements and any other recommendations relative to the now existent fixed capital assets of Monroe County. In addition to the foregoing, from time to time the Capital Improvement Study Committee shall review the needs of the County and make recommen- dations based on their findings for additional needed fixed capital improvements. Such recommendations shall not be confined only to recommendations of what is needed or required but may also include the method and means whereby such recommendations may be accomplished. That in making recommendations after a study is performed, the Committee shall itemize by priority the proposed new future capital improvements. Section 4. MEETINGS -- The Committee as created herein shall meet quarterly, said meetings to be in the months of February, May, August, and November of each and every year. It is also provided that Special Meetings may be called from time to time as is setforth in Section 6 below it being provided that all such meetings shall be held in the 3 locations in the county by rotation, said meeting places located on Plantation Key, at Marathon, and in Key West. Section 5. REMOVAL OF MEMBERS -- If any member should miss more than three (3) consecutive meetings that are unexcused, that member shall thereby be removed from the Committee, and the County Commission shall appoint a successor to fill the position for the balance of the removed member's term. Section 6. GENERAL PROVISIONS -- That for the attending of official meetings, members of this Committee shall be reimbursed their cost of transportation for attending official meetings. Roberts Rules of Order shall be used in the conduct of the meetings of this Committee, it being understood that three (3) members at any officially called meeting shall constitute a quorum. Meetings shall either be called by the chairman or by not less than three (3) other members of the Committee. In the furtherance of this Ordinance it shall be provided that the County Administrator and the variance department heads 2 will lend whatever support is needed and necessary for the accomplishments of the purposes of this Ordinance. Section 7. REVIEW -- This Ordinance and the functions of the Committee appointed hereunder shall be reviewed within one year after the passage of this Ordinance. Section 8. SEVERABILITY -- If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 9. REPEALING CLAUSE -- All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 10. INCLUSION IN THE CODE -- The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be renumbered to conform to the uniform numbering system of the Code. Section 11. EFFECTIVE DATE -- This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
