Ordinance 013-1985County Commission ORDINANCE NO.nlz -1985 AN ORDINANCE AMENDING ORDINANCE NO. 029-1984 AND 9-1985; PROVIDING FOR AN EXEMPTION TO THE MORATORIUM AS EXTENDED BY ORDINANCE NO. 029-1984 AND 9-1985, TO PROVIDE FOR THE BUILDING OF CHURCHES IN GU ZONES AS DEFINED IN CHAPTER 19 OF THE CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE; PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES OF MONROE COUNTY, FLORIDA; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the County Commission of Monroe County, Florida, at public hearing, has been advised by the Monroe County staff that the creation of a moratorium on churches in GU zones is unneces- sary, and WHEREAS, the staff is of the opinion that there would be no adverse impact on the public services of Monroe County for such churches and that there exists a public need for churches to be located in this County to serve the citizens of the County with places to worship. It is also the finding of the Monroe County Commission that such public need for places of worship transcends any adverse impact on the cessation of Major Developments in Monroe County, and WHEREAS, any and all churches to be constructed in GU zones will have to comply with and follow the requirements of the Growth Management Plan for the Florida Keys and/or the Principles of Guiding Development for the Florida Keys and any and all other requirements concerning sensitive lands, now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: Section 1. This Ordinance shall act as an amendment to Ordinance No. 029-1984 and 9-1985, commonly known as the Moratorium Extension Ordinances, and this Ordinance shall only apply to those categories for churches in GU zones and not intended to amend any parts other than this of the Monroe County Zoning Code, to -wit, Chapter 19. The sole purpose of this amendatory ordinance is to provide and allow for the construction of churches in GU zones according to all rules and regulations governing such buildings in this County. Section 2. Church shall be defined as any building used for non-profit purposes by any duly constituted and legally established denomination or sect primarily intended to be used as a place of worship and including customary accessory uses. Section 3. In all other respects, Ordinance No. 029-1984 and 9-1985 remains in full force and effect, and nothing contained herein shall be considered an exception or an exemption to said Ordinance, except as is expressly stated in this ordinance. Section 4. Nothing herein shall negate the requirement to enforce the goals, standards, policies or objects of the Growth Management Plan for the Florida Keys and/or the Principles for Guiding Development for the Florida Keys. Section 5. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 6. All ordinances or parts of ordinances in con- flict with this Ordinance are hereby repealed to the extent of said conflict. Section 7. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 8. This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office. Section 9. All moratoria and restrictions heretofore imposed by the County Commission are hereby ratified nunc pro tunc where and if applicable. Section 10. A certified copy of this Ordinance, as enacted, shall be filed with the Department of Community Affairs of the State of Florida by the Clerk of the Board of County 2 Commissioners of Monroe County, Florida, as soon as practicable after its enactment.
