ORDINANCE NO. 0 15 -1985
AN ORDINANCE REPEALING ORDINANCE NO. 001-
1985 EXCLUDING SECTION "B" THEREOF; PROVIDING
FOR THE REPEAL OF SUBSECTION "B" OF SECTION
19-154 OF THE CODE OF ORDINANCES OF MONROE
COUNTY, FLORIDA; PROVIDING FOR SEVERABILITY;
REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT WITH THIS ORDINANCE TO
THE EXTENT OF SAID CONFLICT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Ordinance No. 001-1985, an amendment to Ordinance
No. 20-1980, was passed and adopted by the Mayor and County
Commission of Monroe County on January 11 A.D. 1985, and
WHEREAS, the County Commission does desire to repeal Ordi-
nance No. 001-1985 and also Section 19-154, Subsection "B", of
Section 19-154 of the Code of Ordinances of Monroe County,
Florida, now, therefore,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1. Repeal. That all of Ordinance No. 001-1985 be
and the same is hereby repealed, except Section "B" of said
Ordinance, which reads as follows: (B) No vacant RU-1 property
shall be used for the purpose of constructing new lobster traps,
crab traps, fish traps or fish nets, including new ropes and
buoys. It shall be prohibited to dip, repair or store used
lobster traps, crab traps or fish traps in any RU-1, RU-5 or
RU-5P zoning districts.
Section 2. Repeal. That Subsection "B" of Section 19-154
of the Code of Ordinances of Monroe County, Florida, be and the
same is hereby repealed.
Section 3. If any section, subsection, sentence, clause or
provision of this Ordinance is held invalid, the remainder of
this Ordinance shall not be affected by such invalidity.
Section 4. All ordinances or parts of ordinances in con-
flict with this Ordinance are hereby repealed to the extent of
said conflict.
Section 5. The provisions of this Ordinance shall be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered as set forth hereinabove.
Section 6. This Ordinance shall take effect immediately
upon receipt of official notice from the office of the Secretary
of State of the State of Florida that this Ordinance has been
filed with said Office.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the loth day of May , 1985.

NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on
Friday, April 12, 1985 at 5:00 P.M. at the Marathon Sub -Court-
house, Marathon, Monroe County, Florida, and on Friday, May 10,
1985, at 5:00 P.M. in Courtroom "B" of the Monroe County
Courthouse, 500 Whitehead Street, Key West, Monroe County,
Florida, the Board of County Commissioners of Monroe County,
Florida, intends to consider the adoption of the following County
Ordinance:

EXCLUDING SECTION "B" THEREOF; PROVIDING FOR THE
REPEAL OF SUBSECTION "B" OF SECTION 19-154 OF THE
CODE OF ORDINANCES OF MONROE COUNTY, FLORIDA;
PROVIDING FOR SEVERABILITY; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH
THIS ORDINANCE TO THE EXTENT OF SAID CONFLICT; AND
PROVIDING FOR AN EFFECTIVE DATE.
Pursuant to Section 286.0105, Florida Statutes, notice is
given that if a person decided to appeal any decision made by the
Board with respect to any matter considered at such hearings or
meetings, he will need a record of the proceedings, and that, for
such purpose, he may need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and
evidence upon which the appeal is to be based.
