Ordinance 017-1985County LU111U LSSion ORDINANCE NO.017 -1985 AN ORDINANCE PROVIDING FOR ASSISTANCE TO THE VARIOUS COUNTY COMMISSIONERS IN THE DEVELOP- MENT OF THE LAND USE PLAN AND LAND USE MAP; DECLARING SUCH ORDINANCE AS AN EMERGENCY MEASURE; PROVIDING FOR SEVERABILITY; PROVID- ING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE TO THE EXTENT OF ANY SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the urgency of passing a Land Use Plan and Land Use Map is one of the first priorities to be accomplished by the Monroe County Commission, and WHEREAS, a moratorium on major developments is in effect in Monroe County and cannot be lifted nor removed until such time as a Land Use Plan and Land Use Map has been adopted, and WHEREAS, the County Commission of Monroe County, Florida, has determined that to prolong any further a delay in adopting the Land Use Plan and Land Use Map would be a grave threat to the health and welfare of the citizens of Monroe County, and WHEREAS, the County Commission has deemed that an emergency has arisen concerning the planning and structuring stage for the Comprehensive Land Use Plan and Map for Monroe County to the extent that assistance is deemed necessary and needed by the various County Commissioners to resolve questions that will arise at the various public hearings, and in particular, the one wherein a line -by-line review of the Land Use Plan and Map will be undertaken, and to prolong it past that time would be a grave danger to the completion of the plan as has been contemplated, and WHEREAS, that in order to promote the public health, safety and welfare of the citizens of Monroe County, Florida, this Ordinance is hereby enacted, now, therefore, BE IT ORDAINED BY THE MAYOR AND COUNTY COMMISSION OF MONROE COUNTY, FLORIDA, as follows: Section 1. That to protract and delay the approval of a Land Use Plan and Land Use Map for Monroe County, Florida, would be unconscionable and a direct threat to the health and welfare of the people of Monroe County, Florida, and to so do, therefore, has created an emergency and it is so declared by the Monroe County Commission. Section 2. That said Ordinance is hereby enacted as an emergency ordinance pursuant to and in accordance with Chapter 125.66(3), Florida Statutes. Section 3. That at the time of the reviewing of the Land Use Plan and Land Use Map, line by line, the various Commis- sioners of Monroe County, Florida, may appoint advisors, up to four (4) in number, for each County Commissioner, who will sit with them in their process as described in this paragraph, and aid them in arriving at the best and most beneficial result of said line -by-line review. Section 4. That compensation for each advisor shall be in the sum of One Hundred Dollars ($100.00) per day, such payment to be at the option of the advisor. Section 5. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 6. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of any such conflict. Section 7. This Ordinance shall be deemed to be filed and shall take effect when a copy has been accepted by the postal authorities of the government of the United State for special delivery by registered mail to the Department of State of the State of Florida.
