ORDINANCE NO. 027-1985
AN ORDINANCE AMENDING ORDINANCE NO 024-1984
IN ORDER TO ALLOW THE USE OF REVENUE OTHER
THAN JUST AD VALOREM REVENUES GENERATED
WITHIN THE GULF DRIVE SPECIAL ROAD TAX
DISTRICT WITHIN SAID DISTRICT; PROVIDING FOR
SEVERABILITY AND PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
Section 1. Section 1 of Ordinance No. 024-1984 is hereby
amended to read as follows:
"Section 1. ESTABLISHMENT.
There is hereby created and established a Special
Road and Bridge District comprised of all property
bordering on Gulf Drive, Big Coppitt Key, Florida,
pursuant to the provisions contained in Section 336.28,
et seq., of the Florida Statutes, and the results of a
Special Referendum of the duly qualified electors of
the said District, held on August 7, 1984. The
authority and power of said District does not flow
exclusively from F.S. 336.28, et seq., and the District
shall have all other authority and power contained in
Chapter 125, Laws of Florida, and all other appropriate
general law."
Section 2. Section 4 of Ordinance No. 024-1984 is hereby
amended to read as follows:
"Section 4. POWERS AND DUTIES
The Board of County Commissioners of Monroe
County, Florida, acting as the governing body of the
District shall have the following powers and duties:
1. The Board may advertise for bids and let
contract or contracts for the construction or recon-
struction, repair or repaving of Gulf Drive within the
District to be performed in conformance with the stan-
dards and requirements for public roads within the
County.
2. The cost of construction or reconstruction,
repair or repaving of Gulf Drive within the District,
which shall not exceed $ 28,500.00 , shall be paid for
by the Board from special assessments as authorized by
this Ordinance, and with funds otherwise designated for
the use of this District.
3. The Board is authorized to impose a special
assessment of $ 9.87 per front foot on all property
within the District and abutting Gulf Drive for the
purposes described in Section 2 of this Ordinance.
Such special assessment shall be noticed, levied and
collected in the same manner as ad valorem taxes
pursuant to F.S. 197.0126, including all provisions
relating to discount for early payment, pre- payment by
installment method, penalty for delinquent payment, and
the issuance of tax certificates and tax deeds, which
shall be of equal dignity with ad valorem certificates
and deeds, and the provisions of F.S. 192.091(2)(c)2."
Section 3. If any section, subsection, sentence, clause or
provisions of this ordinance is held invalid, the remainder of
this ordinance shall not be affected by such invalidity.
Section 4. This Ordinance shall take effect immediately
upon receipt of official notice from the Office of the Secretary
of State of the State of Florida that this Ordinance has been
filed with said Office.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the day of A.D. 1985.

The Board of County Commissioners at a regular meeting in formal
session on August 16, 1985 adopted Ordinance No. 027-1985
amending Ordinance No. 024-1984 in order to allow the use of
revenue other than just ad valorem revenues generated within the
Gulf Drive Special Road Tax District within said District; pro-
viding for severability and providing for an effective date.
