ORDINANCE NO. 035 -1985
AN ORDINANCE ESTABLISHING SPECIAL ASSESSMENTS
AND SERVICE CHARGES FOR GARBAGE COLLECTION
RATES FOR RESIDENTIAL AND COMMERCIAL COLLEC-
TION SERVICE FROM JANUARY 1, 1986 THROUGH DE-
CEMBER 31, 1986; REPEALING ALL ORDINANCES IN
CONFLICT WITH THIS ORDINANCE; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, in accordance with the Monroe County Code of Ordi-
nances, Chapter 8, the Board of County Commissioners of Monroe
County, Florida, is to annually determine, fix, and levy a special
assessment and service charge for garbage collection for residen-
tial and commercial services, and
WHEREAS, upon recommendation of the Manager of the Municipal
Service District the rates to be charged for said service for the
year January 1, 1986, through December 31, 1986, should now be
determined, and
WHEREAS, it is necessary for the public health, safety and
general welfare of Monroe County, Florida, and its citizens that
provision be made for garbage collection and disposal, now, there-
fore,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA:
Section 1. That the following service charges are hereby
established and shall prevail for the period of January 1, 1986,
through December 31, 1986, for residential and commercial garbage
collection, to wit:
1. Annual Service.Charge.for Residential Collection. For
each residential unit as defined by Monroe County Code of Ordi-
nances, Chapter 8, Art. II:
One Hundred Sixty Five Dollars ($165.00) per annum.
2. Service Charge for Commercial Establishments. For each
commercial establishment as defined by the Monroe County Code of
Ordinances, Chapter 8, Art. II, the service charge per month shall
be as follows:

Section 2. All Ordinances or parts of Ordinances in conflict with
this Ordinance are hereby repealed.
Section 3. This Ordinance is not to be included in the Monroe County
Code of Ordinances.
Section 4. A certified copy of this Ordinance, as enacted,
shall be filed with the Office of the Department of State of the
State of Florida by the Clerk of the Board as soon as practicable
after its enactment, and this Ordinance shall take effect immedi-
ately upon receipt of official notice from the Office of the
Secretary of State of the State of Florida that this Ordinance
has been filed with said Office.

NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on
Friday, November 1, 1985, at 2:00 P.M. in Courtroom "B", Monroe
County Courthouse Annex, 500 Whitehead Street, Key West, Monroe
County, Florida, and on Friday, November 15, 1985, at 2:00 P.M.
at the Plantation Government Center, Tavernier, Monroe County,
Florida, the Board of County Commissioners of Monroe County,
Florida, intends to consider the adoption of the following County
ordinance:

evidence upon which the appeal is to be based.
