ORDINANCE NO. 021-1984 AN ORDINANCE OF MONROE COUNTY, FLORIDA, PROVIDING FOR THE MANAGEMENT AND USE OF PROPERTY AT THE KEY WEST INTERNATIONAL AIRPORT; PROVIDING FOR PENALTIES FOR THE VIOLATION OF SAID ORDINANCE; PROVIDING FOR THE ENFORCEMENT OF SAID PENALTIES; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA that: Section 1. Management, Government, and Use The management and use of property and facilities at the Key West International Airport for airport purposes and related purposes ancillary thereto shall be governed by the Monroe County Code and all duly enacted Resolutions and Ordinances which presently exist or which may be adopted in the future by the Board of County Commissioners of Monroe County, Florida, to the extent not preempted by or inconsistent with State or Federal law. It is herein provided that only management and use, including but not limited to the hours of operation, of property and facilities at the Key West International Airport are placed under the government of Monroe County. In all other regards, the City of Key West shall retain its power to govern and regulate property within its jurisdictional boundaries, including the power to impose occupational license requirements and collect fees in connection therewith for operations at the airport. Section 2. Penalties Penalties for the violation of this Ordinance, or for vio- lation of any provisions of the Monroe County Code or of any Resolution or Ordinance of the Monroe County Board of County Commissioners hereby made applicable to the property and facil- ities at the Key West International Airport, shall be the same as the penalties established by the Monroe County County Code, by the particular Resolution or Ordinance enacted by the County, or by State law. Section 3. Enforcement Enforcement of the penalties imposed by this Ordinance, by the Monroe County Code of Ordinances, by any Resolution or Ordi- nance of the Monroe County Board of County Commissioners, or by State law shall be in the same manner in which penalties pre- scribed by the Monroe County Code, or by Resolutions or Ordi- nances of the Board of County Commissioners are enforced. Section 4. Severability If any section, subsection, sentence, clause, or provision of this Ordinance is held invalid, the remainder of this Ordi- nance shall not be affected by such invalidity. Section 5. Effective Date This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
