Ordinance 022-1984Commissioner At.Lavii Fahrer ORDINANCE NO. 022 -1984 AN ORDINANCE AMENDING ORDINANCE NO. 008-1981 OF MONROE COUNTY, FLORIDA; AMENDING SPECIFICALLY SECTION 19 OF THE AFORESAID ORDINANCE NO. 008-1981 AND REQUIRING A LICENSE FOR ALL PERSONS IN THIS COUNTY WHO ARE ENGAGED IN THE RETAIL OR WHOLESALE PURCHASING OR SELLING OF FISH OR SALT WATER PRODUCTS FOR HUMAN CONSUMPTION; PROVIDING FOR THE SEVERABILITY OF THE SAME; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE; PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES OF MONROE COUNTY, FLORIDA; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND COUNTY COMMISSION OF MONROE COUNTY, FLORIDA that: Section 1. Section 19 of Ordinance No. 008-1981 is hereby amended to read as follows: "Section 19. FISH PEDDLERS; CERTAIN PERSONS EXEMPT (1) Any natural person holding a fresh or salt water fish dealer's license, whether it be a license to purchase or sell at wholesale or retail, shall be entitled, without being subject to a general peddler's license tax, to sell or dispose of fish caught or acquired by him by selling or disposing of the same or offering same for sale, direct to the consumer only, from vehicles from place to place in the County where the fish were caught or acquired by the dealer. (2) Any person engaged in the wholesale or retail purchasing or selling of fish or salt water products for human consumption shall be required to obtain an occupational license under the provisions of this Ordinance. This requirement for a wholesale or retail fish license shall require that the person who obtains the same shall establish a business address in Monroe County and in the event said applicant has acquired a home occupational license, any and all sales made under said license shall be done with the home only or the place addressed as the principal place of business only and no other location. Failure to comply with this provision shall subject the violator to a revocation of said license after public hearing before the County Commission and other penalties as prescribed in this Ordinance. (3) No person who holds an occupational license under this section shall sell from a motor vehicle, boat or any other location than their principal place of business as is reflected on the application, unless they have a restaurant license issued by the Florida Department of Business Regulation, wherein prepared seafood is served. (4) Any violation of this Section shall be punishable by provisions of Ordinance No. 008-1981, as amended. (5) No person shall be privileged to sell or vend seafood of any sort except licensed wholesale fish houses and duly licensed retail merchants, as herein prescribed." Section 2. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
