Ordinance 008-1983J--.''� _i �i ORDINANCE NO. 008 -1983 AN ORDINANCE OF THE COUNTY OF MONROE, FLORIDA, PROVIDING THAT THE CODE OF ORDINANCES BE AMENDED BY AMENDING SECTION 19-61 OF ARTICLE IV AND SECTION 19-80 OF ARTICLE V OF CHAPTER 19 OF THE SAID CODE OF ORDINANCES OF THE COUNTY OF MONROE, FLORIDA; PROVIDING AUTOMATIC RECIS- SION OF A SPECIAL USE BY THE PROPER COUNTY ZONING AUTHORITY; PROVIDING FOR THE RECONSIDERA- TION OF ZONING DISTRICT MAP AMENDMENTS OF PRO- VINCIAL VARIANCES BY THE BOARD OF COUNTY COMMIS- SIONERS; PROVIDING A TIME LIMIT, PROCEDURES AND STANDARDS FOR SUCH RECONSIDERATION; PROVIDING FOR SEVERABILITY; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDI- NANCE; PROVIDING FOR INCLUSION AND INCORPORATION IN THE CODE OF ORDINANCES OF THE COUNTY OF MONROE, FLORIDA; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA- Section 1. That Section 19-61 of the Code of Ordinances -of - .the County of Monroe, Florida, be amended so that said section shall read as follows: "Section 19-61. Time Limit on Special Permit If a request for a special use is granted by the Proper Zoning Authority, and the applicant or the applicant's successor shall not initiate action necessary to physically implement on site the approved plans within one year from the date that the request was granted, said special.use shall lapse. It is herein provided that the conditions of this section concerning the one year period for said plans to be implemented, and the provi- sions for the lapse thereof shall be placed on the face of the document representing such special use by using the following language: 'This'special use permit shall lapse at the expiration of one year if no physical implementation on site action is taken thereon within said time.'" Section 2. That Section 19-80 of the Code of Ordinances of Monroe County, Florida, -be amended so that -said section.shall read as follows "Sa�ti nn 1 A_R(1 -2- Reconsideration. If a Zoning District Map Amendment or dimensional variance shall be granted by the proper County Authority, and the applicant or the applicant's successor shall not initiate action necessary to physically implement on site the approved plans within one year from the date the request was granted, the Zoning Director may initiate a request to reconsider said amendment or dimensional vari- ance before the authority having the power to re- zone said property. Such reconsideration shall be pursuant to the procedures and standards as provided in this Article V, Section 19-74 through 19-79, as amended." Section 3. If any sections, subsections, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 4. That all ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. Section 5. That the provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an amendment thereto. Section 6. That this ordinance shall take effect immediately upon receipt of official notice from the office of the Secretary of State of the State of Florida that this ordinance has been filed with said office.
