Commissioner Edwin v. Swift, III ORDINANCE NO.022 -1983 AN ORDINANCE ESTABLISHING REGULATIONS AND CONTROL OF THE USE OF WATERS, HARBORS AND ANCHORAGES IN MONROE COUNTY, FLORIDA; PROVIDING FOR THE USE OF FLOATING STRUCTURES OR LIVE -ABOARD VESSELS IN SAID WATERS; PROVIDING FOR ENFORCEMENT OF SAID REGULATIONS AND CONTROL; DEFINING LIVE -ABOARD VESSELS OR FLOATING STRUCTURES; PROVIDING FOR THE LETTING OF CONTRACTS AND THE ASSESSMENTS FOR SAID SERVICES FOR SUCH FLOATING STRUCTURES OR LIVE -ABOARD VESSELS; PROVIDING FOR THE SEVERABILITY OF THE VARIOUS PROVISIONS HEREOF; PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1. AUTHORITY. In accordance with the provisions of the Florida Statutes Chapter 327 as amended by the 1982 Legislature, this ordinance is hereby authorized and controls the use of floating structures or live -aboard vessels in Monroe County. Section 2. DEFINITIONS. (a) That for the purposes of this ordinance the affected area covered thereby shall be any body of water located in Monroe County which is an enclosed harbor or water space where vessels described in Chapter 327 of the Florida Statutes as amended are anchored. Before declaring any "designated water management area", the County Commission will conduct a public hearing in the area where such water area lies. (b) "Live -aboard" vessel means any vessel used solely as a residence, or any vessel represented as a place of business, a professional or other commercial enterprise, used in conjunction with a legal residence, and is kept in the designated water management area. (c) "Floating structures" are man-made floating objects used either for a business or personal use that is not necessarily a place of residence and is kept in a "designated water management area". That because of the health hazards and the unsightly aesthetics created by either floating structures or live -aboard vessels in the waters of Monroe County, the same shall be controlled by the terms and conditions of this ordinance to include not only the appearances of such in said harbor, but also by the sanitary and health conditions that affect citizens of this County. (d) Commercial vessels such as commercial fishing boats or work boats such as tugs, barges, salvage vessels, passenger vessels, cargo vessels, oil industry vessels, pilot boats, military vessels, and any vessel of LOA 65 feet and over are expressly excluded from this ordinance. Section 3. That since these waters have been devoid of regulations concerning the use of floating structures and live -aboard vessels, the intent of this ordinance is to cause a proper use thereof. So that the same may be uniformly managed, it is provided herein that each vessel or structure located in the waters of Monroe County that falls under the definition as set forth in Section 2 hereof, shall be registered and permitted with Monroe County, as provided herein. The registration shall be of 2 types: short term for daily, weekly or monthly dockage, and long term for yearly dockage. The long term and short term residential registration fees shall be paid through the "dockmaster" as defined in Section 4 for the water management area. A fee schedule shall be agreed to and set forth in the contract between the County and all Dockmasters. A portion of said fees shall be paid to the County and said provision shall be set forth in the contract. Section 4. That so as to maintain a high level of efficient management the County Commission is hereby empowered to enter into a contract or contracts with an able provider or providers for the necessary services required in the designated water management area where such floating structures and live -aboard vessels are located. The contractor will be designated the "dockmaster" of each water management area. Necessary services shall include, but not necessarily be limited to, a garbage and trash disposition method, a land access dock for dinghies and tenders, and shower and bathroom facilities for the "live -aboard" residents. The contract may specify additional services. The laws of the State of Florida concerning the letting of such contracts shall be followed, including advertisement of bids and the letting thereof. The preparation of the bid specifications and attendant documents shall be the duty of the Extension Service Director and his department in conjunction with the County Attorney and the Health Department of Monroe County. It shall be the duty of the Sheriff's Department to enforce the provisions of this ordinance in conjunction with the dockmaster. It shall be the duty of the Extension Service and the County Attorney to enforce compliance with the contract agreement between the dockmaster and the County. Rules and regulations for managing and operating the water management area will be promulgated in the administration of services by the dockmaster of the water management area, the same must be approved by the Port Advisory Authority, or their designee (such as the Port Advisory Committee of Mornoe County). Section 5. No permanent anchored mooring facilities will be allowed under the terms of this ordinance in the confines of any properly designated aquatic preserve in this County. Section 6. Any violation of this Ordinance or duly promulgated Rules and Regulations by the Dockmaster shall be considered a third degree misdemeanor and shall be punished by fine not in excess of $250 or thirty (30) days in jail or both. Section 7. The effective date of this Ordinance shall be October 31, 1983. Section 8. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 9. This ordinance is supplementary to Section 19-180 of the Code of Ordinances of Monroe County, Florida. Section 10. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 11. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.
