ORDINANCE NO. 3-1976
AN ORDINANCE AUTHORIZING AND ENABLING THE BOARD
OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA
TO APPROPRIATE FUNDS OUT OF THE ROAD AND BRIDGE
FUND OF THE MONROE COUNTY BUDGET FOR THE ACQUIRE-
MENT OF TWO TEMPORARY EASEMENTS FOR ACCESS TO AND
FROM A TEMPORARY BRIDGE; DECLARING THE ACQUIREMENT
OF THE TEMPORARY EASEMENTS TO BE A COUNTY, WELFARE
AND PUBLIC PURPOSE; DECLARING EMERGENCY TO EXIST,
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA:
Section 1,
It is hereby declared that due to the
physical condition of Truman Bridge, an emergency exists
requiring the immediate enactment of this Ordinance to acquire
two temporary easements for a Bailey Bridge bypass.
Section 2. The Board of County Commissioners of
Monroe County, Florida may appropriate funds out of its Road and
Bridge Fund of the Monroe County Budget to acquire two temporary
easements for access to and from a temporary bridge to be erected
so as to bypass and discontinue the use of Truman Bridge on Duck
Key, Monroe County, Florida as follows:
a. One six month easement for $243.00 for Lot 1,
Block 14, Duck Key Plat.
b. One six month easement for $290.00 for Lot 28,
Block 1, Duck Key Plat; and the Clerk is authorized to make payment
accordingly.
Section 3.
The acquirement of said easements and
the funds expended for same are hereby decreed to be a County,
Welfare and Public purpose.
Section 4.
This Ordinance shall be deemed to be filed
and shall take effect when a copy has been accepted by the postal
authorites of the Government of the United States for special
delivery by registered mail to the Department of State.
