Ordinance 009-1976 ORDINANCE NO. 9 -1976 AN ORDINANCE AMENDING MONROE COUNTY ORDINANCE NO. 1-1973, AS AMENDED BY MONROE COUNTY ORDI- NANCE NO. 20-1975, ENTITLED "AN ORDINANCE AMEND- ING ORDINANCE NO. 1-1973, ENTITLED 'AN ORDINANCE RELATING TO MONROE COUNTY, FLORIDA; ADOPTING CO}WREHENSIVE ZONING RULES AND REGULATIONS; SET- TING FORTH THE AUTHORITY, INTENT, PURPOSE, METHODS, SHORT TITLE, DEFINITIONS, APPLICATION PROCEDURES, AND SPECIAL EXCEPTIONS; PROVIDING FOR AMENDMENTS AND APPEALS, ADMINISTRATION AND ENFORCEMENT, GENERAL PROVISIONS, ZONING, GENERAL USE, RESIDENTIAL, BUSINESS DISTRICTS, ETC. '''; BY AMENDING PARAGRAPH 2.1 OF SECTION 2 OF ARTICLE VI TO PROVIDE FOR COMPENSATION OF MEMBERS OF THE BOARD OF ADJUSTMENT OF $50.00 PER MONTH AND FOR MILEAGE REIMBURSEMENT OF FOURTEEN CENTS PER MILE TO AND FROM BOARD MEETINGS; DECLARING SAID COMPENSATION AND MILEAGE PAYMENTS TO BE A COUNTY, WELFARE AND PUBLIC PURPOSE; AUTHORIZING THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, TO APPROPRIATE FUNDS OUT OF THE GENERAL REVENUE FUND OF THE MONROE COUNTY BUDGET FOR SAID PAYMENTS; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. That paragraph 2.1 of Section 2 of Article VI of Monroe County Ordinance No. 1-1973 as amended by Monroe County Ordinance No. 20-1975 be and the same is hereby amended to read as follows: "2.1 BOARD OF ADJUSTMENT The Board of Adjustment shall consist of five members, each to be appointed by the Board of County Commissioners for a term of one (1) year, or until a successor is appointed, and removable by a three-fifths (3/5) vote of the Board of County Commissioners. Vacancies shall be filled for the unexpired term of any member whose term becomes vacant. The Board shall elect from its membership a chairman and a vice-chairman and such other officers as the Board may deem neces- sary or proper. The Chairman, Vice-Chairman and other officers of the Board of Adjustment shall serve for one year and may succeed themselves upon re-election to the office by the Board. The Secret- tary shall be the Zoning Official or his authorized representative. -2- Each member of the Board of Adjustment shall receive $50.00 per month as compensation regardless of number of meetings attended and in addition thereto each member shall receive travel reimbursement consisting of fourteen cents (14~) per mile traveled to and from any regularly scheduled Board meeting or official func- tion of said Board, provided the same be in-county travel. Travel without the county shall be first authorized by the Board of County Commissioners and thereafter said Board member shall be compensated for his travel in like manner as other county employees." Section 2. The travel of the Board of Adjustment to and from meetings and the expenditures therefore are hereby decreed to be a County, welfare and public purpose and the Board of County Com- missioners may appropriate funds out of its General Revenue Fund of the Monroe County Budget to the members of the Board of Adjust- ment for the purpose of said payments and the Clerk is authorized to make payments accordingly. Section 3. This Ordinance shall take effect upon receipt of the official acknowledgment from the Department of State acknow- ledging receipt of certified copy of this Ordinance and that said Ordinance has been filed in said office.
