- AN ORDINANCE PROHIBITING THE UNLOADING OF SHRIMP
FROM COMMERCIAL FISHING VESSELS WITHIN MONROE
COUNTY, FLORIDA, - UNLESS SHRIMP ARE REMOVED OR
UNLOADED AT A REGULARLY ESTABLISHED COMMERCIAL
SHRIMP .BUSINESS HOUSE WHICH IS DULY LICENSED
- UNDER THE LAWS OF THE STATE OF. FLORIDA, AND
WHICH IS OPEN AND OPERATING ITS BUSINESS AT THE
TIME OF SUCH UNLOADING; AND PROVIDING EXCEPTIONS;
PROVIDING FOR A PENALTY; REPEALING ALL ORDINANCES ,
PARTS OF ORDINANCES AND RESOLUTIONS IN CONFLICT
.WITH THE PROVISIONS OF THIS ORDINANCE; AND PRO-
VIDING WHEN THIS ORDINANCE SHALL TAKE EFFECT.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF .
MONROE COUNTY, FLORIDA:
Section 1. From and after the passage of this Ordinance,
it shall be, and it is hereby declared to be unlawful for any
person, firm, or corporation, their agents , servants or employees_,
to remove or unload shrimp from any commercial fishing vessel with-
in the unincorporated limits of Monroe County, Florida, unless
such shrimp are removed, or unloaded, at a regularly established
commercial shrimp business house which is duly licensed under the
laws of the State of' Florida, and is operating such business at the
time of such removal or unloading .
Section 2 . By the term "commercial fishing vessel" as
used -in Section 1 herein, is meant any boat or vessel which is re-
quired to be numbered or registered or enrolled by and under the
laws of the United States of America or, the State of Florida and
which vessel or boat is used for the purpose of taking or catching,
or assisting in the taking or catching of shrimp for pay or for- the
• purpose 'of 'sale, barter or exchange, or which is used for the pur-
pose of taking or catching, or assisting in the taking or catching
of shrimp for pay, barter or exchange.
By the term "commercial shrimp business" as used in Section
1 hereof., is meant any person, firm or corporation who or which
operates a shrimp house, plant or other establishment for compensa-
tion or profit for the purpose of unloading and handling from com-
mercial fishing vessels .

Section 3. Nothing herein contained shall be so con-
strued to prohibit a regularly established commercial shrimp busi-
ness house which is duly licensed under the laws of the State of
Florida from removing or unloading shrimp from any commercial fish-
ing vessel to a motor vehicle for transport to said duly licensed
commercial shrimp business , or to prohibit an owner or lessee of
a commercial boat from selling his shrimp to buyers other than
to shrimp houses .
Section 4. (a) Nothing herein contained shall be so
construed to prohibit the removal, transferring or unloading under
the direct and personal supervision of the registered owners of
the vessel.
(b) The owner of the vessel shall produce upon demand
by any law enforcement officer or other person authorized by law
positive verification of ownership of the vessel and personal
identification of the owner.
Section 5 . Should any person, firm or corporation, their
agents , servants or employees , violate the terms and provisions
of this Ordinance, such person, firm or corporation shall be deemed
guilty of a misdemeanor and upon conviction thereof by a Court of
competent jurisdiction, shall be fined in any sum not less than
One Hundred Dollars ($100 . 00) nor more than Two Hundred Fifty Dollars
($250. 00) .
Section 6 . It is declared to be the Commission' s intent
in passing this Ordinance that if any section, sub-section, sentence,
clause or provision of this act is held invalid, the remainder of
this act shall not be affected.
Section 7 . All Ordinances , parts of Ordinances , and
Resolutions in conflict herewith are hereby repealed to the extent
of said conflict.
Section 8. This Ordinance shall take effect upon the
receipt of official acknowledgment from the office of the Secretary
of State of the State of Florida that said Ordinance has been filed
in said office.

of Monroe County, Florida, intends to consider the adoption of the
