RESOLUTION NO. 441-1989
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA,
AUTHORIZING THE MAYOR/CHAIRMAN OF THE
BOARD TO EXECUTE AN AGREEMENT BY AND
BETWEEN AL'S WRECKER SERVICE AND MONROE
COUNTY CONCERNING THE REMOVAL OF ABANDONED
VEHICLES.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, that the Mayor/Chairman of the Board is hereby authorized to execute
an Agreement by and between AI's Wrecker Service and Monroe County concerning
the removal of abandoned vehicles, a copy of same being attached hereto.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,

CONTRACT, made this day of
the Board of County Commissioners of Monroe
(Board)
, 1989, between
County, Florida
AND
AI's Wrecker Service, 106010 Overseas Highway, Key Largo, Florida
(AI's)
RECITALS
A. For the past thirteen months, AI's has been collecting
and disposing abandoned vehicles in the Florida Keys at no cost
to the County.
B. Both parties wish to have a written contract and to
include a hold-harmless clause in the written form.
C. In order to eliminate the possible health and safety
hazards posed by abandoned vehicles and in order to promote the
esthetics of the Keys, and in consideration of the mutual
covenants expressed herein, it is agreed that:
1. CONTRACT PERIOD This is a one-year contract,
beginning on 1 July 1989 and ending on 30 June 1990, unless
renewed or terminated as provided below.
2. CONTP~CT RENEWAL - This contract is renewable by either
party. Notice of intention to renew shall be given at least 60
days before the applicable anniversary date.
3. CONTRACT TEP~lINATION - This contract may be terminated
for any reason by either party on 30-day written notice.
4. SUBJECT MATTER OF CONTRACT - This contract is for the
collecting, storing, crushing and transporting of abandoned
vehicles.
5. DEFINITION OF ABANDONED VEHICLE - Abandoned vehicle
means any vehicle which has been tagged by a law enforcement
agency acting by virtue of the authority vested in it by Chapter
705, Florida Statutes.
6. AL' S DUTIES - At no charge to the County, AI's shall
pick up and haul to sites owned or leased by the County all
vehicles abandoned throughout the Keys within a reasonable time
after the vehicles are tagged as such. When a sufficient number
of vehicles have accumulated at any of the sites, AI's shall
bring a crusher to the site, crush the vehicles and remove them
from Monroe County. Crushed vehicles shall not be allowed to
accumulate at any of the sites.
7. COUNTY'S DUTIES - The County shall:
(a) furnish three lots at no charge to AI's for the
storage and crushing of abandoned vehicles.
(b) handle stolen vehicles according to existing policy
of the Monroe County Sheriff's Department, which shall include,
but not be limited to:
(1) locating and determining the status, whether
stolen or derelict, of all vehicles appearing to have
been abandoned;
(2) issuing appropriate property receipts and
holding vehicles for resolution by the owner or any
insurance company which may have issued a policy on a
vehicle;
(3) notifying lienholders of vehicle status and
County's intent to destroy a vehicle;
(4) posting notices of intent to remove, where
applicable;
(5) ensuring that vehicles are removed by
notifying AI's of their location; and
(6) documenting all removals in order to made
accurate records.
8. HOLD HARMLESS - AI's shall indemnify, hold harmless and
defend the County and its directors, officers, agents and
employees against all claims, loss, damage, charges or expense to
which they, or any of them, may be subjected resulting from any
negligent acts, or failures to act, on the part of AI's in the
performance of the duties described in this contract.
