ORDINANCE NO. 023 -1990
AN ORDINANCE DECLARING THAT AN EMERGENCY
EXISTS AND WAIVING NOTICE BY A FOUR -FIFTH'S
VOTE; REQUESTING THE SUPERVISOR OF ELECTIONS
TO PLACE ON THE NOVEMBER 6, 1990, GENERAL
ELECTION BALLOT A REFERENDUM QUESTION

PROVIDING FOR REPEAL OF ALL ORDINANCES
INCONSISTENT HEREWITH; PROVIDING FOR
INCORPORATION INTO THE MONROE COUNTY CODE;
AND PROVIDING AN EFFECTIVE DATE.
�-.. °MEREAS HB 3859 provides that, in order to create a
county -wide solid waste authority, a referendum regarding the
creation must be held at the November 6, 1990, general election,
and
WHEREAS, time is of the essence in getting the question to
the Supervisor of Elections for placement on ballot, now,
therefore,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1. An emergency is hereby declared and notice
waived by a four -fifth's vote.
Section 2. The Supervisor of Elections is hereby
requested to place the following referendum question on the
November 6, 1990, general election ballot for all of Monroe
County including the municipalities therein:
SOLID WASTE AND RESOURCE RECOVERY
AUTHORITY OF MONROE COUNTY
Shall the Solid Waste and Resource Recovery
Authority of Monroe County be approved? If
approved by the voters of the City of Key
West and of the remaining area of Monroe
County, the Act will establish the Solid
Waste and Resource Recovery Authority of
Monroe County. The Authority will have the
power to create, establish, construct,
acquire, improve, expand, operate, and
maintain a unified waste collection, resource
recovery, and disposal system for entire
Monroe County, including municipalities, as
authorized under special act of the
Legislature. There shall be five trustees
appointed, one from each County Commission
district, to the Authority's Board of
Trustees by a full joint board consisting of
all members of both the Board of County
Commissioners of Monroe County and the City
of Commissioners of the City of Key West, all
of whom shall vote on the appointments. All
members of the Board of Trustees must be
qualified electors of Monroe County.

Section 3. If any section, subsection, sentence, clause
or provision of this Ordinance is held invalid, the remainder of
this Ordinance shall not be affected by such invalidity.
Section 4. All ordinances or parts of ordinances in
conflict with this Ordinance are hereby repealed to the extent of
said conflict.
Section 5. The provisions of this Ordinance shall be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform
numbering system of the Code.
Section 6. This Ordinance shall take effect when a copy
has been accepted by the postal authorities of the Government of
the United States for special delivery by registered mail to the
Department of State.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 1st day of August , A.D. , 1990.
