07/24/2002 SpecialMINUTES OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS Special Meeting Board of County Commissioners Wednesday, July 24, 2002 Key Largo, Florida 2002/ 196 A Special Meeting of the Monroe County Board of County Commissioners convened at 9:00 A.M., on the above date at the Key Largo Library. Present and answering to roll call were Commissioner Humberto "Bert" Jimenez, Commissioner Murray Nelson, Commissioner George Neugent, Commissioner Dixie Spehar, and Mayor Charles "Sonny" McCoy. Also present were Danny L. Kolhage, Clerk; James Roberts, County Administrator; James Hendrick, County Attorney; County Staff, members of the press and radio; and the general public. All stood for the Invocation and Pledge of Allegiance. ADDITIONS, CORRECTIONS, DELETIONS Motion was made by Commissioner Neugent and seconded by Commissioner Nelson granting approval of the Agenda. Motion carried unanimously. FISCAL YEAR 2003 BUDGET County Administrator James Roberts addressed the Board concerning the status of the County budget at the present time with the adjustments made according to the Board's actions on July 19, 2002. Jennifer Hill, Budget Director with the Office of Management & Budget addressed the Board concerning the proposed millage rates as they were affected by the changes made on July 19, 2002. After discussion, motion was made by Commissioner Spehar and seconded by Commissioner Nelson to remove from the budget the additional funding allocated to the Health Department in the amount of $350,000; and also, reduce the Sheriffs budget by $452,000 by removing the additional proposed deputy positions for traffic enforcement on the 18 Mile Stretch. Motion carried unanimously. Motion was made by Commissioner Jimenez and seconded by Commissioner Nelson to remove the additional appropriation of $36,700 granted to the Human Service Advisory Board on July 19, 2002. Motion carried unanimously. FIRE & AMBULANCE DISTRICT I BOARD OF GOVERNORS The Board of Governors for District #1 convened. Present and answering to roll call were Commissioner Humberto "Bert" Jimenez, Mayor Charles "Sonny" McCoy, Commissioner George Neugent, Commissioner Dixie Spehar. Chairperson Yvonne Harper was absent. 07/24/02 2002/197 Public Safety Director, Reggie Paros addressed the Board. Ms. Hill addressed the Board concerning current status of the budget and proposed millage rates for the Board of Governors for District #1. Motion was made by Commissioner Spehar and seconded by Mayor McCoy to waive the Board's adopted Fund Balance policy and authorize the budgeting of 80% of the estimated fund balance. Motion carried unanimously, with Chairperson Harper not present. Motion was made by Commissioner Spehar and seconded by Commissioner Jimenez authorizing the County Administrator to certify a millage rate to the Monroe County Property Appraiser for the Board of Governors for District #1 for Fiscal Year 2003 in the amount of 1.9093 which represents a 20.99% increase over the rollback rate of 1.5780. Motion carried unanimously, with Chairperson Harper not present. There being no further business, the meeting of the Board of Governors for District #1 was adjourned. The Board of County Commissioners reconvened with all Commissioners present. PUBLIC SAFETY, UPPER KEYS TRAUMA, MEDICAL EXAMINER Mr. Paros addressed the Board concerning the proposed budget request for Fiscal Year 2002-2003 . COMMUNITY SERVICES Mr. Roberts discussed and presented information concerning the proposed library homework center to be located in the Poinciana Housing Project in Key West. Motion was made by Commissioner Nelson and seconded by Commissioner Neugent to take no action at this time. Motion carried unanimously. COMMISSIONERS' ITEMS Motion was made by Commissioner Nelson and seconded by Commissioner Spehar granting approval for the transfer of three buildable lots from Naples Cattle Co., Inc. to Monroe County by Warranty Deeds for properties described as Lot 20, Roger Lowes Subdivision, Big Pine Key, Permit Number 01-3-4133; Lot 10, Block 14, Palm Villa Subdivision, Big Pine Key, Permit Number 01-3-4131; and Lot 9, Block 7, Ramrod Shores, Ramrod Key, permit number 01-3-4134. The applicants are receiving three dwelling unit awards for the year ending July 13, 2002, have filed the documents in accordance with Ordinance No. 47-1999. Motion carried unanimously. COUNTY ADMINISTRATOR Mr. Roberts addressed the Board. Motion was made by Commissioner Neugent and 07/24/02 2002/198 seconded by Commissioner Spehar granting approval to terminate the purchase contract for the Mariners Resort Welcome Center building on Big Pine Key. Motion carried unanimously. Mr. Roberts addressed the Board concerning approval of Resolution ratifying agreement reached by the Intergovernmental Task Force for allocation of Florida Department of Environmental Protection Grant Funding for wastewater and stormwater projects among Monroe County and its five municipal governments. After discussion, motion was made by Commissioner Nelson and seconded by Commissioner Spehar to table to the next Key Largo meeting. Roll call vote was taken with the following results: Commissioner Jimenez No Commissioner Nelson Yes Commissioner Neugent No Commissioner Spehar No Mayor McCoy No Motion failed. Motion was then made by Commissioner Neugent and seconded by Commissioner Jimenez to adopt the following Resolution approving an Agreement reached by the Intergovernmental Task Force for allocation of Florida Department of Environmental Protection Grant Funding for wastewater and stormwater projects among Monroe County and its five municipalities. Roll call vote was taken with the following results: Commissioner Jimenez Yes Commissioner Nelson Yes Commissioner Neugent Yes Commissioner Spehar No Mayor McCoy Yes Motion carried. RESOLUTION NO.311-2002 Said Resolution is incorporated herein by reference. Motion was made by Commissioner Nelson and seconded by Commissioner Neugent directing that the county portion of the funding and any other unused funds of the approximate $5,000,000 be applied to county projects ready to proceed. Roll call vote was unanimous. Mr. Roberts discussed guidance from the County Commission in reference to the sale of the Stock Island property to the City of Key West and the possible purchase of additional sites. The Board directed the County Administrator to advise the Botanical Society that the County would not be interested in any conveyance of the Stock Island property that involve any costs to the County. 07/24/02 2002/ 199 GROWTH MANAGEMENT Growth Management Director Tim McGarry addressed the Board concerning the proposed budget request for Fiscal Year 2002-2003. COUNTY ADMINISTRATOR Mr. Roberts presented the proposed millages as they stand at the present time with the changes made by the Board on this date. Motion was made by Commissioner Spehar and seconded by Commissioner Nelson authorizing the County Administrator to certify the proposed millages for Fiscal Year 2003 to the Monroe County Property Appraiser and setting the dates, times, and places of the Public Hearings on the budget. (See Attachment #1, 2003 Millage Rates - Proposed Budget and Attachment #2, Public Hearings). Motion carried unanimously. Mr. Roberts addressed the Board concerning status of the negotiations with Key West Resort Utilities for wastewater improvements in South Stock Island. Mayor McCoy called a Special Meeting of the Board of County Commissioners to be held on Wednesday, July 31, 2002 at 10:00 A.M. at the Harvey Government Center in Key West to consider a proposed Contract between Monroe County and Key West Resort Utilities.
