12/05/2007 Special 2007/286 MINUTES OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS Special Meeting Board of County Commissioners Wednesday, December 5, 2007 Key West, Florida A Special Meeting of the Monroe County Board of County Commissioners convened at 10:00 A.M., at the Harvey Government Center. Present and answering to roll call were Commissioner Mario DiGennaro, Commissioner Sylvia Murphy, Commissioner George R. Neugent, Commissioner Dixie M. Spehar and Mayor Charles "Sonny" McCoy. Also present at the meeting were Thomas J. Willi, County Administrator; Danny L. Kolhage, Clerk; Isabel C. DeSantis, Deputy Clerk; County Staff, members of the press and radio; and the general public. The Board discussed a resolution notifying Monroe County Administrator, Thomas J. Willi that the County will be terminating his employment without cause by canceling his employment contract effective January 4, 2008. The following individuals addressed the Board: Joe Weatherby, Pauline Klein, Chris Norwood, Sloan Bashinsky, Rudy Krause, Christine Russell, Diane Beruldsen, and Harry Miller. Debbie Frederick, Deputy County Administrator read into the record a letter from Representative Stan Mayfield. After discussion, motion was made by Commissioner Spehar and seconded by Commissioner Murphy to approve the Resolution and pre-litigation settlement in the amount of$282,354.84 which includes salary, benefits and Florida retirement as part of the employment contract. After further discussion, motion was made by Commissioner DiGennaro and seconded by Mayor McCoy requesting an amendment to the motion to keep the County Administrator in place for 90 days. Suzanne Hutton, County Attorney indicated that unless the maker and the second of the original motion accept the amendment, the motion for an amendment could not be made. Said amendment was not accepted by the maker or the second. Roll call vote was taken on the original motion with the following results: Commissioner DiGennaro Commissioner Murphy Commissioner Neugent Commissioner Spehar Mayor McCoy No Yes Yes Yes No Motion carried. RESOLUTION NO. 484-2007 Said Resolution is incorporated herein by reference. 2007/287 Motion was made by Commissioner DiGennaro and seconded by Mayor McCoy to keep the County Administrator in place for 90 days. Suzanne Hutton, County Attorney ruled the motion out of order as a result of the maker not being on the prevailing side. The motion was withdrawn. Commissioner Spehar requested the following item be added to the agenda: Approval for the appointment of Debbie Frederick to serve as the Acting County Administrator, effective December 5, 2007 and authorization for her to re-task County Staffto assist with the management of the County to the extent that she deems appropriate. Motion was made by Commissioner Spehar and seconded by Commissioner Neugent granting approval for the item to be added to the agenda. Roll call vote was unanimous. Motion was made by Commissioner Spehar and seconded by Commissioner DiGennaro approving the appointment of Debbie Frederick to serve as the Acting County Administrator, effective December 5, 2007 and authorization for her to re-task County Staff to assist with the management ofthe County to the extent that she deems appropriate. The Board and Ms. Frederick discussed her appointment as Acting County Administrator. Tom Willi, County Administrator addressed the Board. Roll call vote was unantmous. The Board instructed Ms. Frederick to begin the search process for the selection of a County Administrator. * * * * * The Board of County Commissioners and the Key West City Commission convened. A presentation was given by Capt. J. R. Brown, representing Naval Air Station Key West of the Air Installations Compatible Use Zones (AICUZ) for Naval Air Station Key West's Boca Chica Field. The following individuals addressed the Board: Rosario Scavelli, Peter Anderson, Sloan Bashinsky, John Hannnerstrom, representing the Florida Keys Citizens Coalition; Bill Hunter, Kim Wigington, representing Harbor Shores; James Wallace, Ron Miller, representing the Upper Keys Citizen's Association; Melody Cooper, Steve Wigington, Paul Caruso, representing Stop the Planes.com; Robert DeHaven, Brenda Conroy, Diane Beruldson, R. L. Blazevic, John Jones, and Kim Villone. No official action was taken. There being no further business, the meeting of the Board of County Commissioners was adjourned. Danny L.
