Key Colony Beach
A Special Meeting/Public Hearing of the Monroe County
Board of County Commissioners convened at 5:05 p.m. on the above
date at the City Hall in Key Colony Beach. Present and answering
to roll call were Commissioner Earl Cheal, Commissioner Douglas
Jones, Commissioner Jack London, Commissioner John Stormont, and
Mayor Wilhelmina Harvey. Also present were Rosalie Connolly,
Deputy Clerk; Randy Ludacer, County Attorney; Tom Brown, County
Administrator; County Staff; members of the Press and Radio; and
the general public.
A Public Hearing was held regarding the selection of
building permitting procedures. Proof of publication was noted
for the record. Division Director Bob Herman addressed the Board
and discussed which variation of building permitting procedures
Staff should finalize for adoption. Bill Smith, representing the
Florida Keys Contractors Association, and George Kundtz, Chairman
of the Florida Keys Citizens Association, also addressed the
Board. Staff was directed to author a short paragraph explaining
the differences in the options and present back to the Board in
finalized form at the next scheduled Public Hearing at 5:00 p.m.
on October 16th and also directed, on the supposition that Option
III is chosen, that the excess or conflicting wording in Chapter
6 be cleared up before it is brought back to the Board. Motion
was made by Commissioner Stormont and seconded by Commissioner
Jones to continue to the next Public Hearing on October 16th.
Motion carried unanimously.
A Public Hearing was held regarding the proposed
Ordinance establishing criteria for managing stormwater runoff in

Monroe County. Steve Ferris addressed the Board and discussed
the contents of the proposed Ordinance. County Attorney Randy
Ludacer also addressed the Board. After further discussion by
the Board, Jocelyn Branscome and Jim Smith of the South Florida
Water Management District addressed the Board. The Board and
Staff then discussed the brochure that was prepared by Post
Buckley Schuh & Jernigan that was to be made part of the proposed
Ordinance. Motion was made by Commissioner Cheal and seconded by
Commissioner Stormont to terminate the contract with Post Buckley
Schuh & Jernigan for this project and turn the funds back to
South Florida Water Management District. County Attorney Ludacer
again addressed the Board regarding this matter. Motion was
withdrawn. After comments from Division Director Bob Herman,
motion was then made by Commissioner Jones and seconded by
Commissioner Cheal to direct the County Administrator to notify
Post Buckley Schuh & Jernigan to have a representative of the
firm present at the October 16th meeting to justify their work
product to the Board. Motion carried unanimously. Motion was
then made by Commissioner Stormont and seconded by Commissioner
London to continue to the next Public Hearing on October 16th.
Roll call vote was unanimous.
A Public Hearing was held on a proposed Ordinance
amending the Land Development Regulations, establishing
procedures for the imposition, calculation, collection,
expenditure and administration of library, park, solid
waste/recycling, transportation, police, and fire protection/EMS
impact fees on new development. Marty Leitner of the consulting
firm of Freilich, Leitner, Carlisle & Shortlidge made a
presentation to the Board of proposed new impact fees. George
Kundtz, Chairman of the Florida Keys Citizens Coalition,
addressed the Board. After lengthy Board discussion, motion was
made by Commissioner London and seconded by Commissioner Jones to
continue to the next Public Hearing at 5:05 p.m. on October 16th
at Key Colony Beach. Motion carried unanimously. The Board then
entered into a discussion regarding school impact fees. Motion
was made by Commissioner Jones to direct Staff to research impact
fees for schools. During discussion, motion was withdrawn.
After further discussion, motion was made by Mayor Harvey and
seconded by Commissioner Cheal to direct Commissioner Jones to
act as representative of the Board of County Commissioners to
address the School Board regarding school impact fees. Motion
carried unanimously.
There being no further business,
were continued to 5:05 p.m. on October 16th
City Hall.
