A Special Meeting of the Monroe County Board of County Commissioners convened
at 10:00 A.M., at the Harvey Government Center. Present and answering to roll call were
Commissioner Heather Carruthers, Commissioner George R. Neugent, Commissioner Danny
Kolhage, Commissioner David Rice and Mayor Sylvia Murphy. Also present at the meeting
were Roman Gastesi, County Administrator; Bob Shillinger, County Attorney; Lindsey
Ballard, Deputy Clerk; County Staff, members of the press and radio; and the general public.
ADDITIONS, CORRECTIONS, DELETIONS
Item A A motion was made by Commissioner Rice and seconded by Commissioner
Carruthers granting approval of the Additions, Corrections and Deletions to the Agenda.
Motion carried unanimously.
PUBLIC HEARING
Item B A Special Hearing to Review, Discuss and Direct Proposed Amendments to the
Monroe County Year 2010 Comprehensive Plan, which were drafted based upon the results of
the Technical Document Update, Evaluation, and Appraisal Report and Extensive Public
Comment which includes Additional Policy Issues not included in the EAR, in order to
Finalize the draft, Proposed Monroe County 2030 Comprehensive Plan.
3.9 Sanitary Sewer
1. Goal 901 and Policy 901.4.1: Do not add reference to Florida Keys Reasonable Assurance
Document suggested by public speaker; however, staff will bring back draft policies in the
Conservation and Coastal Management Element that recognize the issue of impaired waters
in canals.
The following individual addressed the Board: Beth Ramsay- Vickery.
3.10 Drainaue
1. Policy 1001.1.1: Add: "Water Quality/ antic ....."
Add: " All projects should be designed in accordance with the Florida Department of
Transportation and South Florida Water Management District standards and taking into
account projections for climate change after first sentence of this policy.
2. Policy 1001.1.3: Insert — "Monroe County shall maintain, review and update, as necessary,
the County's Stormwater Management regulations and Stormwater Master Plan

3. Policy 1001.1.4: Change timeframe to three (3) years.
4. Policy 1001.1.7: Delete policy (language added to Policy 1001.1.1).
Policy 1001.2.2: Keep this policy, but edit as per legal recommendation: "...those projects
which allow the County to m°°* its legal r °° ,: °m ° *° provide access."
6. Policy 1001.2.3: Delete policy.
7. Policy 1001.24 Delete policy.
A motion was made by Commissioner Kolhage and seconded by Mayor Murphy to leave
the change in Policy 1001.2.2 and eliminate Policy 1001.1.7, Policy 1001.2.3 and Policy
1001.2.4. Motion carried unanimously.
3.8 Solid Waste
1. Policy 801.3.1: Delete policy.
2. Policy 801.3.2: Delete policy.

4. Policy 801.4.2: Change: Within 3 years the County will evaluate the development of a
county -wide mandatory recycling program
- agree to remove the word "curbside,” as shown in draft.
5. Policy 901.4.5: Monroe County shall strive to achieve separation of at
least 50 percent of its construction and demolition debris.
The following individual addressed the Board: Julie Dick, representing Last Stand and
Florida Keys Environmental Fund. A motion was made Commissioner Carruthers and
seconded by Commissioner Rice to move Mayte's suggestion on prior language.
3.7 Potable Water
1. Policy 701.4.2: Staff will bring more information to the July BOCC meeting regarding
whether requirements for adequate fire flow at the time of construction permit apply to
commercial development, residential development, or both.
2. Policy 701.5.6: Add the word "safe" to this policy — "Monroe County shall permit and
encourage rainwater stefag f e ili es f r all household u su eh a 4 ratio, an d
beat washing, at a minimu capture for all non - potable uses and for safe household potable
uses.
3. Policy 701.6.2: Add to the Glossary definitions for "developed areas" and "undeveloped
areas." BOCC will revisit this policy after definitions are drafted.

3.13 Intergovernmental Coordination
1. Goal 1301: Add " and providers of utility services to the goal after "federal governments."
2. Policy 1301.8.2: " Monroe County shall evaluate the development of a county -wide,
mandatory recycling program for residential and commercial locations, utilizing available

3. Policy 1302.14 Delete "either' ' and "or voluntary'; Add "or development agreement' ' to
first bullet point; Add bullet — "The applicant shall pay the cost of the public notice and
advertising for the community meeting.
4. Policy 1302.1.5: Delete "either' ' and "or voluntary';
5. Add as a new Policy: " Within one (1) year after the adoption of the 2030 Comprehensive
Plan, Monroe County shall adopt land development regWations requiring a private applicant
to participate in a concept meeting with the Planning and Environmental Resources
Department with the submission of an application for amendment to the text of the Land
Development Code and/or Comprehensive Plan. Private proposals to amend the text of the
Land Development Code and/or Comprehensive Plan, based upon the concept meeting,
shall require a public meeting with the Board of County Commissioners whereby County
staff will identify county -wide impacts for the Board of County Commissioners in a written
document. The initiation public meeting will allow the public to have input. Aprivate
applicant shall pay the costs of the concept meeting and for the public notice and advertising
required for the Board of County Commissioners meetings.
The following individuals addressed the Board: Naja Girard, representing Last Stand; Beth
Ramsay- Vickery and Julie Dick, representing Last Stand and Florida Keys Environmental
Fund. A motion was made by Commissioner Rice and seconded by Commissioner Neugent
to accept recommendation of Staff on the new language. A Roll Call vote was taken with the
following results:

3.5 Ports, Aviation and Related Facilities
1. Policy 501.1.3: delete: By May 1, 2015,

- Monroe County shall consider adopting an ordinance regulating incompatible uses such
as the operation of ultralights, balloons, parachutes, kites, banner towing, model
airplanes and similar activities within the proximity of the public airports or private
airstrips to the extent legallypossible
2. Policy 501.7.1: Delete policy.
Policy 502.3.3: Delete the phrase, "at a depth consistent with coastal and
Caribbean shipping vessels ".
3.6 Housing
1. Goal 601: Delete "all current and future ".
2. Objective 601.1: Delete "and moderate ".
3. Directed staff to make changes to the Comp Plan and land development regulations
necessary to conform our income classifications to those of the Monroe County Housing
Authority.
A motion was made by Commissioner Kolhage and seconded by Commissioner Rice to
make whatever changes that are necessary. Motion carried unanimously.
4. Add new policy: " Monroe County shall maintain land development regulations on
inclusionary housing and shall evaluate expanding the inclusionary housing requirements to
include or address nonresidential and transient development and redevelopment based on
specific data and analysis.
A motion was made by Mayor Murphy and seconded by Commissioner Rice to accept
Mayte's wording. ARoll Call vote was taken with following results:

5. Policy 601.1.2: Delete "and moderate ".
6. Objective 601.3: develop a definition for "substandard housing" to be included in
the Glossary, and consider adding policy (601.3.5) for facilitating ability of
residents to acquire grant funding from FEMA and other sources to address
existing housing that is nonconforming to current flood regulations.
3.12 Recreation and Open Space
No changes.
3.11 Natural Groundwater Aquifer Recharge

Policy 1101.2.2: Delete policy — consistent with decision to delete Policy 1001.2.3
in Drainage Element.
5.0 Public Participation and Comment
1. Add bullet: The County shall post applications on the County website

4.0 Monitoring and Evaluation Procedures
No changes.
Glossary
1. Carrying Capacity: change last 2 "ands" to "or."
2. Add definitions of "developed area" and "undeveloped area."
3. Disturbed Land: Delete "that existed on the site prior to the disturbance."
4. Add definition of "substandard housing," as discussed with Objective 601.3.
5. Add definition of "tropical hardwood hammock."
