04/13/2016 Special.i.. y" , MINUTES OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS APRIL 13, 2016 Special Meeting Board of County Commissioners Wednesday, April 13, 2016 Marathon, Florida A special meeting of the Monroe County Board of County Commissioners convened at 10:00 a.m. at the Marathon Government Center. Present and answering to roll call were Commissioner Danny Kolhage, Commissioner Sylvia Murphy, Commissioner George Neugent, Commissioner David Rice, and Mayor Heather Carruthers. Also present at the meeting were Bob Shillinger, County Attorney; Roman Gastesi; County Administrator, Amy Heavilin; County Clerk, Cheryl Robertson, Deputy Clerk; county staff and members of the general public. ADDITIONS, CORRECTIONS, DELETIONS Item Al Motion was made by Commissioner Murphy and seconded by Commissioner Neugent granting approval of the additions, corrections and deletions to the agenda. Motion carried unanimously. A copy of the approved changes are attached at the end of these minutes for reference. PUBLIC HEARING (COMPREHENSIVE PLAN) Item B 1 The second of two Public Hearings to consider adopting an ordinance of the Monroe County Board of County Commissioners amending the Monroe County Year 2010 Comprehensive Plan to be consistent with the results of the Technical Document Update (Data and Analysis), the adopted 2012 Evaluation and Appraisal Report and the 2014 Evaluation and Appraisal Notification Letter and adopting the Monroe County Year 2030 Comprehensive Plan, Attached as Exhibit l: providing for severability, providing for the repeal of conflicting provisions, providing for transmittal to the State Land Planning Agency and the Secretary of State; providing for inclusion in the Monroe County Comprehensive Plan, Providing for an effective date. No public speakers. Mayte Santamaria, Senior Director of Planning and Environmental Resources set the stage. Debra Love presented a presentation of the Comprehensive Plan. A motion was made by Commissioner Rice and seconded by Commissioner Kolhage for approval. No objections to adopting the Comprehensive Plan. Motion approved unanimously. ORDINANCE #005 -2016 IS INCORPORATED HEREIN BY REFERENCE PUBLIC HEARING (LAND DEVELOPMENT CODE) Item B2 The second of two Public Hearings to consider adoption of an ordinance of the Monroe County Board of County Commissioners amending the Monroe County Land Development Code (LDC) to be consistent with the proposed Monroe County Year 2030 Comprehensive Plan, the results of the Comprehensive Plan Technical Document Update (Data and Analysis), the adopted 2012 Evaluation and Appraisal Report and the 2014 Evaluation and Appraisal Notification Letter, Page 1 of 3 MINUTES OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS APRIL 13, 2016 LDC attached as Exhibit 1, providing for severability; providing for the repeal of conflicting provisions; providing for transmittal to the State Land Planning Agency and the Secretary of State; providing for inclusion in the Monroe County Code; providing for an effective date. Public Speakers; Bill Hunter and final speaker Mira Negron (towers- footage). Legal and Growth Management Staff have their direction. Steve Williams, Assistant County Attorney, addressed the Board. A Motion was made by Commissioner Murphy and seconded by Commissioner Rice for approval. No objections to adopting the Land Development Code. Motion approved unanimously. ORDINANCE #006 -2016 IS INCORPORATED HEREIN BY REFERENCE PUBLIC HEARING Item B3 A public hearing to consider adoption of an ordinance by the Monroe County Board of County Commissioners amending the Monroe County Comprehensive Plan, adopting the 10 -Year Water Supply Plan Update to be consistent with the South Florida Water management District Lower East Coast Water Supply Plan Update of 2013. No public speakers. Emily Schemper, Comprehensive Planning Manager, addressed the Board. A motion was made by Commissioner Kolhage and seconded by Commissioner Neugent for approval. Motion approved unanimously. ORDINANCE #007 -2016 IS INCORPORATED HEREIN BY REFERENCE COMMISSIONER CARRUTHERS Item D1 Discussion regarding Florida Power & Light Cooling Canal System (CCS) serving the Turkey Point Nuclear Facility. Discussion of concerns by each Commissioner. Julie Cheon, Water Quality and Environmental Manager, addressed the Board. After discussion, it was agreed upon by the Commissioners of the following: (1) send letter to Miami Dade, (2) legal staff to draft a resolution to include the following: (a) what the importance of this issue is to us and our drinking water, (b) what our concerns are, (c) address the issue of needing more information and working with the Aqueduct Authority (possibly a joint resolution), and to find a comprehensive plan to stop this migration, and (3) for all parties to be in attendance on April 20 for the BOCC meeting held in Marathon, Florida.
