05/06/1994 Special 94/144 MINUTES OP THE MONROE COUNTY BOARD OP COUNTY COMMISSIONERS Special Meeting Board of County Commissioners Friday, May 6, 1994 Key West A Special Meeting of the Monroe County Board of County Commissioners convened at 1: 30 P.M. , on the above date, at the Stock Island Chapel. Present and answering to roll call were Commissioners Earl Cheal, Mary Kay Reich, Wilhelnina Harvey, and Mayor London. Commissioner Shirley Freeman was not present. Also present were Danny L. Kolhage, Clerk; Randy Ludacer, County Attorney; James Roberts, County Administrator; County Staff; members of the Press and Radio; and the general public. All stood for the Invocation and Pledge of Allegiance. ADDITIONS, CORRECTIONS, DELETIONS There were no Additions, Corrections, or Deletions to the Agenda. DIVISION OP GROWTH MANAGEMENT Motion was made by Commissioner Cheal and seconded by Commissioner Reich granting approval of the deletion of Agenda item D-1 concerning approval of an Opinion of Counsel Letter and Non-Appropriation of Funds Addendum regarding the Minolta MIMS 3000 EL Filing and Retrieval System. Motion carried unanimously, with Commissioner Freeman not present. Special Litigation Council, James T. Hendrick, addressed the Board concerning the Department of Community Affairs (DCA) Rule 28.20. 024 regarding changes to the Monroe County Land Development Regulations. The following individuals addressed the Board: Lloyd Good, Eddie McWhorten, Donna Merritt, and Ken MetCalf of the Department of Community Affairs. Motion was made by Commissioner Harvey and seconded by Mayor London to delete under the heading MANGROVES AND SUBMERGED 94/145 LANDS, the following: (ii) in a subdivision which was approved before 1986. During discussion, the motion was withdrawn. Motion was made by Commissioner Harvey and seconded by Mayor London to withdraw Monroe County's challenge to the Department of Community Affair's proposed Land Development Regulations concerning MANGROVES AND SUBMERGED LANDS as outlined in a letter from the Department of Community Affairs dated May 2, 1994, with the recommendation to the Department of Community Affairs that the language contained in Section 9.5-345 (m) (2) (g) be deleted as follows: (ii) in a subdivision which was approved before 1986. During discussion, Ken Metcalf of the Department of Community Affairs and Code Enforcement Director, Marty Arnold, addressed the Board. Roll call vote was taken with the following results: Commissioner Cheal No Commissioner Harvey Yes Commissioner Reich No Mayor London Yes Motion failed, with Commissioner Freeman not present. SOUNDING BOARD The following individuals addressed the Board concerning blasting on No Name Key: Faye Daniels, Laura Lee Daniels, Tony Paternitti, of Pinewood Materials, Inc. , and Special Litigation Council, James T. Hendrick. No official action was taken. DIVISION OP GROWTH MANAGEMENT Motion was made by Commissioner Reich and seconded by Commissioner Harvey to reconsider the Board's previous action concerning the Department of Community Affairs (DCA) Rule 28- 20.024 regarding changes to the Monroe County Land Development Regulations. Roll call vote was unanimous, with Commissioner Freeman not present. Motion was made by Commissioner Reich and seconded by Commissioner Harvey to withdraw Monroe County's challenge to the 94/146 proposed rule with the Department of Community Affairs concerning SEAWALLS, RIPRAP AND FENCES WITHOUT A PRINCIPAL USE; BIG PINE FENCES; and MANGROVES AND SUBMERGED LANDS, as outlined in a letter from the Department of Community Affairs dated May 2, 1994, with the recommendation to the Department of Community Affairs that the language contained in Section 9.5-345 (m) (2) (g) be deleted as follows: (ii) in a subdivision which was approved before 1986. Roll call vote was taken with the following results: Commissioner Cheal No Commissioner Harvey Yes Commissioner Reich Yes Mayor London Yes Motion carried. Motion was made by Mayor London and seconded by Commissioner Harvey that Code Enforcement, Planning, and Growth Management Departments resolve problems of inconsistencies in reference to fences on Big Pine Key and come back to the Board with a recommendation prior to the public hearings to be conducted by the Department of Community Affairs. Roll call vote was unanimous, with Commissioner Freeman not present. There being no further business, the meeting was adjourned.
