05/20/2003 Special 2003/1 05 MINUTES OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS Special Meeting Board of County Commissioners Tuesday, May 20, 2003 Key Largo, Florida A Special Meeting of the Monroe County Board of County Commissioners convened at 4:00 P.M., on the above date at the Key Largo Library. Present and answering to roll call were Commissioner Charles "Sonny" McCoy, Commissioner Murray Nelson, Commissioner George Neugent, Commissioner David P. Rice, and Mayor Dixie Spehar. Also present were Danny L. Kolhage, Clerk; James Roberts, County Administrator; Richard Collins, County Attorney; County Staff, members of the press and radio; and the general public. All stood for the Invocation and Pledge of Allegiance. ADDITIONS, CORRECTIONS, DELETIONS Richard Collins, County Attorney addressed the Board. Motion was made by Commissioner Neugent and seconded by Commissioner Rice to add to today's Agenda a request from the County Attorney to direct litigation counsel to bring closure, prior to June 9th, the county's activities in the pending litigation - Associates, LP and Ohio Key I, Inc. v. Monroe County. Motion carried unanimously. COUNTY ATTORNEY Mr. Collins addressed the Board. Motion was made by Commissioner Rice and seconded by Commissioner Neugent granting approval of a request from the County Attorney to direct litigation counsel to bring closure, prior to June 9th, the county's activities in the pending litigation - Associates, LP & Ohio Key I, Inc. v. Monroe County. Motion carried unanimously. GROWTH MANAGEMENT A Public Hearing was held concerning adoption of an Ordinance, at the request of the Key Largo Wastewater Treatment District, creating a Municipal Service Taxing Unit (MSTU) for Key Largo. The Board accepted public input with the following individuals addressing the Board: Glenn Patton, representing the Island of Key Largo Federation of Homeowner's Associations; Charles Brooks, representing the Key Largo Wastewater Treatment District; Richard Lancaster, representing the Hammer Point Owner's Association; Geri Smith, Robert Sheets, District Manager of the Key Largo Wastewater Treatment District; Vicky Fay, representing the Key Largo Trailer Village; Jerry Wilkinson, and Robert E. Burt, President of the Key Largo Trailer Village. James Roberts, County Administrator and Tim McGarry, Growth Management Director discussed wastewater projects and funding thereof. After discussion, motion was made by OS/20/03 2003/106 Commissioner McCoy and seconded by Commissioner Nelson to adopt the following Ordinance creating the Key Largo Wastewater Treatment District Municipal Service Taxing Unit located within the unincorporated area of Monroe County, Florida, to provide wastewater and reclaimed water services and facilities; defining the boundaries of the unit; authorizing the Board to annually levy ad valorem taxes within the boundaries of such unit not to exceed 0.35 mil; authorizing the use of the tax revenue for enumerated purposes; and providing an effective date. Roll call vote was taken with the following results: Commissioner Nelson Yes Commissioner Neugent No Commissioner Rice Yes Commissioner McCoy Yes Mayor Spehar Yes Motion carried.
