01/06/2004 Special MINUTES OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS 2004/1 Special Meeting Board of County Commissioners Tuesday, January 6, 2004 Key West, Florida A Special Meeting of the Monroe County Board of County Commissioners convened at 10:45 AM" on the above date at the Harvey Government Center at Historic Truman School in Key West. Present and answering to roll call were Commissioner Charles "Sonny" McCoy, Commissioner George Neugent, Commissioner David P. Rice, Commissioner Dixie Spehar, and Mayor Murray E. Nelson, Also present were Danny L Kolhage, Clerk; Dent Pierce, Acting County Administrator; Richard Collins, County Attorney; County Staff, members of the press and radio; and the general public. All stood for the Invocation and Pledge of Allegiance. ADDITIONS, CORRECTIONS, DELETIONS Motion was made by Commissioner Spehar and seconded by Commissioner Rice granting approval of the Agenda, Motion carried unanimously. Colleen Castille, Secretary of the Florida Department of Community Affairs made a presentation before the Board in reference to an agreement on actions needed to be taken by the State of Florida and Monroe County to meet the needs of wastewater, environmentally sensitive lands and workforce housing to be in alignment with the Monroe County Comprehensive Plan and Work Program. Growth Management Director Tim McGarry addressed the Board and discussed the Conceptual Proposal for a Cooperative Agreement between DCA and Monroe County to addresses significant Outstanding Work Program Issues. The Board accepted public input with the following individuals addressing the Board: Henry Morgenstern, representing the Florida Wildlife Federation; Charlie Bradford; Dennis Henize, representing Last Stand; Joan Borel, Tina Henize, and H. T. Pontin. The Board recognized State Representative Ken Sorenson for receiving the Florida Association of Counties (F AC) County Champion Award, The Board returned to public input with the following individuals addressing the Board: John Dolan-Heitlinger, Donald Craig, Ed Scales, Bicycle Joanie Nelson, Sandy Walters, Capt. Ed Davidson, Chairman of the Florida Keys Citizens Coalition; Debra Harrison, representing the 1/6/04 2004/2 World Wildlife Fund; Bill Loewy, representing Habitat For Humanity; Alicia Putney, Kathryn Wheeler, representing the Big Pine Civic Association; Katie Lyons, and Virginia Panico, representing the Key West Chamber of Commerce. Mr. McGarry addressed the Board. Monroe County Land Use Attorney, James T. Hendrick discussed his letter dated January 6, 2004, Re: Potential liability for short-term moratorium. After discussion, motion was made by Commissioner McCoy and seconded by Commissioner Spehar to approve the Conceptual Proposal for a Cooperative Agreement between DCA and Monroe County to address significant Outstanding Work Program Issues, as amended, including the recommendations outlined in the January 6,2004 opinion letter. Said amendment as follows: Page 2 of 4: HABITAT PROTECTION - Proposed Commitments by the County 1. Institute an interim moratorium on ROGOINROGO allocation awards in areas containing two acres or greater of native upland vegetated lands within Conservation and Natural Areas until amendments are made to the Comprehensive Plan and Land Development Regulations. [This is a modified version of Option #3 in the staff memorandum sent under separate cover.] Roll call vote was taken with the following results: Commissioner Neugent No Commissioner Rice Yes Commissioner Spehar Yes Commissioner McCoy Yes Mayor Nelson Yes Motion carried. There being no further business, the meeting of the Board of County Commissioners was adjourned. Danny L.
